A.
Applicability of state standards. Plumbing standards
of the New York State Uniform Fire Prevention and Building Code and any succeeding
code have been made applicable to the City of Batavia pursuant to Article
18 of the Executive Law. Wherever the provisions of the Plumbing Standards
of the State Uniform Fire Prevention and Building Code conflict with rules
and regulations of the Examining Board of Plumbers, the more stringent of
the two shall apply.

B.
Definitions. Any words used in this article shall have
the meanings respectively ascribed to them in the New York State Uniform Fire
Prevention and Building Code, and any succeeding code, applicable to plumbing.
C.
Performance of work. All plumbing work in the City of
Batavia shall be performed pursuant to the plumbing standards of the State
Uniform Fire Prevention and Building Code and any succeeding code. All licenses,
permits and inspection shall be obtained pursuant to the rules and regulations
for the registration of plumbers and installation of plumbing and drainage
as adopted by the Examining Board of Plumbers of the City of Batavia and Article
4 of the New York State General City Law, where applicable.
D.
Certified plumbers to perform work. All plumbing and
drainage work within the property lines of any building within the City of
Batavia, except where a permanent right-of-way has been granted to the city,
shall be performed only by those persons certified as competent by the Examining
Board of Plumbers pursuant to rules and regulations adopted by such Board
and the provisions of Article 4 of the General City Law, and are licensed
by the City of Batavia.
E.
Licensed plumbers; permits. Permits for plumbing and
drainage work shall be issued only to licensed plumbers. Permits for new work
must be obtained prior to the commencement of such work. On repairs to plumbing
heretofore installed, a permit must be obtained by the plumber within 48 hours
of the time the work is commenced.
F.
Home owner's permit. Any permit required by this article
for work shall be issued to any person who owns and resides in either a single-
or two-family dwelling used exclusively for living purposes, including the
usual accessory buildings and quarters in connection with such dwelling and
to any person who is building and constructing either a single or two-family
dwelling on land owned by him or her. Plumbing work included under this permit
shall include all plumbing work to be performed inside the walls of said dwelling
and/or accessory buildings and quarters in connection with such dwelling,
and such plumbing work shall be personally performed by the owner of the dwelling.
All fees established by this article shall be paid to the plumbing inspector
before the permit is issued. A homeowner will not be permitted under this
permit to make any connections to the water system or the sewer system of
the City of Batavia.
G.
Fees. Fees for plumbing permits shall be as set from
time to time by resolution of the City Council.

H.
Exemption for minor plumbing work. Notwithstanding the requirements in Subsections A through G herein, no permit is required for the plumbing work set forth hereinafter, and the same may be performed by a homeowner as defined in Subsection F herein or a licensed plumber. The work performed must be done pursuant to the applicable standards and code set forth in this section. No fee shall be required for this designated minor plumbing work.

Replacing faucets and faucet washers.

Replacing traps under lavatories and sinks.
(3)
Opening stoppages on drain lines with no replacement
of piping.
(4)
Stopping leaks on water and drain lines with no replacement
of piping.
(5)
Installing or replacing water filters.
(6)
Installing or replacing ice makers which may include
replacement of the soft copper supply line to the valve.
(7)
Replacing garbage disposals.
(8)
Replacing dish washing machines which may include replacement
of the soft copper supply line to the valve.
(9)
Replacing washing machines.
(10)
Replacing laundry trays which may include replacement
of the chrome line to the valve.
(11)
Replacing kitchen sinks which may include replacement
of the chrome line to the valve.
(12)
Replacing bathroom sinks which may include replacement
of the chrome line to the valve.
(13)
Replacing toilet tank parts; provided that an antisiphon
ballcock must be installed.
A.
Fee schedule. All persons holding a certificate of competency
from the Examining Board of Plumbers shall obtain an annual license pursuant
to the rules and regulations of such Board and shall pay fees as set from
time to time by resolution of the City Council.

B.
Grounds for refusal. The Board of Plumbing Examiners
shall refuse to issue an annual license to any plumber who has refused or
otherwise failed to correct violations of the applicable plumbing regulations,
when a notice of violation has been sent to such plumber and failure to correct
such violation is at least 60 days in arrears.
City forces or any contractor performing work in the streets of the
City of Batavia under contract with the City may install lateral water and
sewer connections from water and sewer mains in City streets to property lines
without obtaining plumbing permits so long as said work is under the design
and inspection of the City Engineer or his or her representative.
A.
Qualifications; appointment. The Examining Board of Plumbers
shall have such qualifications and powers as are established by law. The members
of the Board shall be appointed and shall serve as provided in Article 4 of
the General City Law.
B.
Meetings of Board. The Examining Board of Plumbers shall
meet:

In addition to the powers granted by law, upon the formal written request
by the Manager, he or she shall have the authority to inspect plumbing work
in any building within the city, whether or not a permit has been issued,
in the interest of public safety and public health.
It shall constitute an offense punishable as provided in § 51-45 for any person found to be violating any provision of this article, or the rules and regulations of the Examining Board of Plumbers, or the plumbing standards of the State Uniform Fire Prevention and Building Code and any succeeding code.
A.
Service of notice. Any such person in violation shall
be served by the City with written notice stating the nature of the violation
and providing a time limit, as hereinafter set forth, for the satisfactory
correction thereof. The offender shall, within the period of time stated in
such notice, permanently cease all violations.

Plumber. A licensed plumber, being a person holding a
certificate of competency from the Examining Board of Plumbers, shall be given
a three-day notice, as set forth by law.
(2)
Other person. Any other person shall be given a ten-day
notice to correct the violation and permanently cease violation.
B.
Owner's responsibility. Where notice, as hereinabove
provided, is given to a licensed plumber, a copy of such notice shall be given
to the owner of the premises, or person occupying the premises. If the violation,
as set forth in the notice, is not corrected within 10 days therefrom, the
owner of the premises shall be in violation. Proof of ownership of the premises
during the period of time in which the violation takes place is presumptive
evidence of knowledge and consent by the owner to the commission of acts constituting
the violation.
The penalties set forth in § 51-45 of this chapter shall govern in all instances. In addition thereto, any certificate of competency or license issued to a plumber by the Examining Board of Plumbers may be suspended or revoked for violations of the provisions of this article, the rules and regulations of the Examining Board of Plumbers or the plumbing standards of the State Uniform Fire Prevention and Building Code.
