Any open excavations in the City of Batavia used for commercial or industrial purposes shall be enclosed with a substantial chain link fence or equally protective type at least six feet in height with gates of equally protective strength that can be closed and locked while the premises are not in use.
A. 
Any property owner, tenant or person having control of property shall not permit any excavation which because of its depth, steepness, propensity to accumulate water or otherwise prove to be harmful or dangerous to be unprotected and shall provide adequate fencing, barricades or other protection sufficient to prevent children and other unauthorized persons from entering the premises or falling into the excavation within the time limit provided in Subsection B.
B. 
Whenever the Bureau of Inspection determines that an excavation is harmful or dangerous, he or she shall serve a written order directing the person responsible to either fill in the excavation; render the excavation safe in some other manner or provide suitable fencing or other enclosure and require that such condition be remedied within a reasonable time; provided, however, that the time to perform shall not exceed 30 days from date of service of the order.
