In order to help emergency personnel respond quickly to an emergency, it is in the best interest of the public health, safety and welfare for the City of Batavia to enact this article.
As used in this article, the following terms shall have the meanings indicated:
BUILDING
The principal building or buildings on each lot and shall not include any accessory building.
BUREAU OF INSPECTION
The Bureau of Inspection in the Department of Public Works is responsible for enforcing compliance with this article.
The Assessor's Office and the Bureau of Inspection shall be authorized to determine which buildings are to be numbered.
A. 
The number to be posted in accordance with this article shall be the address used by the United States Post Office and listed in the City Assessor's office. If these numbers are not the same, the Bureau of Inspection shall make a determination of which one to use for compliance with this article.
B. 
The Assessor's Office shall designate separate numbers for buildings which have no designated street number, and shall also have the authority to redesignate numbers for buildings when deemed necessary.
C. 
Any property owner aggrieved by the determination of the Bureau of Inspection may seek review of that determination by the City Manager upon a written submission to the City Manager setting forth the reasons for seeking such review. The City Manager shall be authorized to confirm or modify or change the determination of the Bureau of Inspection in the exercise of his or her reasonable discretion, and such determination shall be final and binding.
It shall be the duty of every building owner in the City of Batavia to cause to be displayed the street number of said building in accordance with the criteria stated in this article, and to maintain such number in compliance with these provisions.
A. 
The street number of each building, as defined in § 51-50 above, shall be displayed on the building, or on a post, mailbox or other structure located at a point between the building and curb or edge of street pavements as long as such location is within 75 feet of the curb or edge of pavement. Where the building is on a corner lot, the number shall, at a minimum, be located on the side which corresponds to the designated street address.
B. 
The numeric figure or figures are to be at least four inches in height and shall be placed on the front of said building or on a post or other structure in a prominent and conspicuous place and in such manner as to be plainly legible and visible from the center of the street which the building faces, as prescribed in Subsection A. The color of said figures shall be in sharp contrast to the color of their background. So far as the intent of this article is concerned, the front of a building shall be identified as that side which faces the street corresponding to the address defined in § 51-50.

C. 
The number shall be so placed that it will not be obstructed by trees, shrubbery, porches or other extensions of the building.
D. 
Wherever practicable, said number shall be placed near some light or source of illumination so that it may be readily seen at night.
E. 
In the event that more than one house has access from a single driveway, a street number of the house must be displayed at each location.
The display of any house number other than the number authorized or assigned by the Assessor's Office and/or Bureau of Inspection is expressly prohibited.
A. 
Noncompliance is deemed a violation. Any person, corporation, partnership or other entity owning a building within the City of Batavia and refusing or neglecting for 60 days after notice from the Bureau of Inspection to place the proper designated number on said building shall be deemed in violation of this article.
B. 
Service of notice. The notice provided for in Subsection A may be given by personal service or by first class mail to the last known address of the owner as shown on the last assessment roll on file in the City Assessor's office.
C. 
Numbering of building by City. In the event of the neglect or refusal of any owner, after notice to cause said building to be properly numbered, the Bureau of Inspection may cause said building to be properly numbered and the cost assessed as a lien against the property of the owner and collected in the same manner as other City taxes.
Any person, corporation, partnership or other entity violating any of the provisions of this article shall, upon conviction, be punishable by a fine not to exceed $250. Each calendar week or portion thereof that said violation continues shall be deemed a separate violation.
