This chapter shall be known as the Games of Chance Ordinance of the
City of Batavia.
Authorized organizations may, upon obtaining a license in accordance
with this section, conduct games of chance within the City of Batavia as provided
in Article 9-A of the General Municipal Law and as provided in this section.
Such games of chance shall be conducted in accordance with Article 9-A of
the General Municipal Law and with the rules and regulations of the New York
State Racing and Wagering Board and with this section. The provisions of Article
9-A of the General Municipal Law, together with any amendments thereto, shall
be deemed to be incorporated in this section.
Games of chance may be conducted on Sunday between the hours of 12:00
noon and 12:00 midnight, except that no games of chance shall be conducted
on Easter Sunday, Christmas Day or New Year's Eve.
The Batavia Police Department shall exercise control over and supervision
of all games of chance. The Chief of Police shall review all applications
for licenses and make recommendations concerning such applications to the
City Clerk.
This chapter shall be submitted for the approval of the electors at
the general election to be held on the third day of November, 1981, and shall
take effect immediately upon the approval of a majority of the electors voting
in said election.
