[Adopted 1-26-1981 as Ch. 65, § 65.71 and Art. IX, of the 1981 Code]
As used in this article, unless the context or subject matter otherwise requires, the following terms shall have the meanings indicated:
DRIVEWAY
Every entrance or exit used by vehicular traffic to or from lands or buildings abutting a highway.
PARKING AREA
Any place, lot, parcel, yard or enclosure used in whole or in part for the parking, keeping, storing or housing of five or more motor vehicles and not accessory to one- and two-family residences.
Any person being the owner, manager, operator or otherwise in charge of any parking area or driveway the surface of which parking area is made of dirt, sand, cinders or other loose material shall at all times keep the same thoroughly treated with water, calcium chloride or other means so that dust, sand, cinders or other substance comprising said surface will not be raised, carried or blown by the wind, movement of vehicles or other causes, into or upon public property or the adjacent property of others.
Any person being the owner, manager, operator or otherwise in charge of any parking area or driveway shall provide suitable drainage at his or her own cost or expense to prevent water draining upon public streets or adjoining property in such quantity or manner as to create a nuisance or hazard.
Upon complaint duly made in writing to the Director of Public Works or his designee that any parking area or driveway is not being maintained in accordance with the provisions of this article, the Director of Public Works or his designee shall cause an investigation to be made. If the investigation reveals a failure to comply with the provisions of this article, written notice shall be sent by ordinary mail to the owner, manager, operator or person otherwise in charge of the premises involved demanding compliance within 10 days after the mailing of the notice.

Except as otherwise provided in this article, any person violating any provision of this article shall be punishable by a fine of not more than $250 or imprisonment for not more than 15 days, or by both such fine and imprisonment.
