A.
The Planning Board of the Village of Baxter Estates shall be comprised of five members, who shall be appointed by the Mayor, with the consent of the members of the Board of Trustees, each of whom shall satisfy the requirements of New York State Village Law § 7-718, Subdivision 3. Those persons appointed to the Planning Board immediately following the effective date of this § 48-1 shall be deemed to constitute the original members of the Planning Board for purposes hereof.
B.
One original member shall serve for a term that expires on the fourth anniversary of the first annual organization meeting of the Board of Trustees that occurs after the effective date of this § 48-1; one original member shall serve for a term that expires on the third anniversary of the first annual organization meeting of the Board of Trustees that occurs after the effective date of this § 48-1; one original member shall serve for a term that expires on the second anniversary of the first annual organization meeting of the Board of Trustees that occurs after the effective date of this § 48-1; one original member shall serve for a term that expires on the first anniversary of the first annual organization meeting of the Board of Trustees that occurs after the effective date of this § 48-1; and one original member shall serve for a term that expires at the first annual organization meeting of the Board of Trustees that occurs after the effective date of this § 48-1.
C.
Upon
expiration of the terms of office of each original member, each successor
shall be appointed for a term of five years. One member shall be appointed
annually by the Mayor to serve as Chairperson of the Planning Board.
The Planning Board shall have all powers, duties and jurisdiction
granted to it under the Village Code of the Village of Baxter Estates
and to village planning boards within the State of New York and the
County of Nassau pursuant to the New York State Village Law, the Nassau
County Charter (Chapter 879 of the Laws of the State of New York of
1936, as amended), and any other general or special statute, law,
rule or regulation now or hereafter in effect, including, without
limitation, the Village Code of the Village of Baxter Estates, except
to the extent such grant of powers, duties and jurisdiction is limited
as restricted by provisions of the Village Code of the Village of
Baxter Estates.
