No person owning, possessing or harboring any animals shall suffer or allow such animals in any manner to be unconfined, running loose, or at large at any place whatsoever, whether on public or private property.
Any such animal found unconfined, running loose, or at large within the Village may be seized by any peace officer.
A. 
No person owning, harboring or possessing any dog or cat shall allow, suffer or permit it to defecate on any common thoroughfare, sidewalk, play area, park or on any public property. The foregoing restriction shall not apply to that portion of any street lying between the curblines, so long as all feces deposited by such dog or cat shall immediately be removed and disposed of by any sanitary method.
B. 
No person owning, harboring or possessing any dog or cat shall allow, suffer or permit it to defecate on any private property without the permission of the owner of said property.
C. 
No dog or cat feces shall be deposited in any Village storm drains or storm drainage infrastructure.

A. 
Each and every violation of, or failure to comply with, any provision of this article shall constitute a violation, punishable as follows: for a conviction of a first offense, by a fine not more than $250, or imprisonment for a period not to exceed 15 days, or both such fine and imprisonment; for a conviction of a second offense, both of which were committed within a period of five years, by a fine not less than $250, nor more than $500, or imprisonment for a period not to exceed 15 days, or both such fine and imprisonment; and for a conviction of a third or subsequent offense, all of which were committed within a period of five years, by a fine not less than $500, nor more than $1,000, or imprisonment for a period not to exceed 15 days, or both such fine and imprisonment.
B. 
Each occasion upon which any such animal shall be found unconfined, running loose or at large, and each occasion upon which any dog or cat is found defecating in violation of § 71-3, shall be deemed a separation violation of this article with respect to each such animal and each such instance.
