It is the intention of the Mayor and the Board of Trustees of the Incorporated Village of Bayville to adopt a local law known as the "Bayville Freshwater Protection Law" in order to comply and incorporate the provisions of Article 24 of the New York Environmental Conservation Law. It is expressly intended by the Mayor and the Board of Trustees of the Incorporated Village of Bayville by this chapter to avoid transferring authority with respect to the issuance of permits and promulgation of regulations regarding activities in freshwater wetlands and adjacent areas to higher levels of government.
The Village Board may, in order to provide for the general welfare, safety and protection of its freshwater wetlands, adopt and promulgate specific regulations with respect to the issuance of permits and the regulation of activities in its freshwater wetlands and adjacent areas.
This chapter shall be deemed implemented upon its adoption, notwithstanding the fact that the New York State Department of Environmental Conservation has not yet filed an appropriate Freshwater Wetlands Map for the Incorporated Village of Bayville.
The Bayville Freshwater Protection Law is intended to conform and be consistent with Article 24 of the New York Environmental Conservation Law.
The purpose of the Bayville Freshwater Protection Law is to retain jurisdiction over the aforesaid freshwater wetlands, and to that end the said law is hereby declared to be subject to modification and revision.
