This chapter is intended to abolish the Board of Elected Assessors pursuant to Real Property Tax Law § 328 and establish the office of single appointed Assessor pursuant to Real Property Tax Law § 310.
A. 
On and after April 12, 2023, the offices of assessor in the Town of Berne created under Local Law 1 of 1971 shall be abolished and there shall be but one Assessor for the Town of Berne, appointed by the Town Board, in accordance with the provisions of § 310 of the Real Property Tax Law of the State of New York.
B. 
The terms of office of assessors presently serving the Town of Berne shall terminate at 12:00 midnight on September 30, 2025.
Pursuant to Real Property Tax Law § 328, this chapter shall not be subject to a referendum.
Should any section or provision of this chapter be declared invalid, such decision shall not affect the validity of the remaining portions hereof.
This chapter shall become effective upon filing with the Secretary of State of the State of New York as provided by the Municipal Home Rule Law.
