As used in this chapter, the following terms shall have the meanings indicated:

CURRENCY
Includes legal tender or other express substitutes as tokens.
CURRENCY-OPERATED AMUSEMENT DEVICE
A mechanical electric or electronic device used or designed to be operated for entertainment or as a game by the insertion or placement of currency or by paying currency to have it activated.
CURRENCY-OPERATED AMUSEMENT DEVICE PARLOR
A building or establishment containing six or more currency-operated amusement devices, including devices in operable and in inoperable condition.

No person, firm, corporation or other entity or group shall place or deliver for use, or use or permit the use of, any coin-controlled amusement device within the Village of Blasdell without first procuring a license and paying the fee hereinafter to the Village Clerk.

Application shall be made in writing to the Village Clerk for the issuance of a license for each coin-operated machine. The application shall state in detail the name and address of the owner of the machine, the name of the manufacturer, the serial or other identifying number of the machine, a description of the function of the machine and the address of the premises where the machine is to be located, together with other information which may be required by the Clerk.

A fee as set by the Board of Trustees shall be paid by the owner of each machine licensed and shall accompany the presentation of the application to the Village Clerk.

Any license granted pursuant to the provisions of this chapter may be transferred or assigned only upon approval of such transfer or assignment by the Village Clerk. A fee as set by the Board of Trustees will be charged for each transfer.

The owner of said license must contact the Village Clerk within five days of the transfer of the machine.

Such license shall be issued for a period of one year beginning January 1 of each year and ending December 31 of the same year. The licensing fee shall be prorated from the date of the issuance and based upon the remaining number of months in the then-current licensing year. If such license shall not be obtained and paid for by January 1 of such year, there shall be added to the amount of the specified license fee a penalty in the amount of 10% of the specified fee, which penalty shall be paid in addition to the specified fee before a license shall be issued for such business, trade or occupation.

For each machine or parcel found to be in violation of this chapter, the owner shall be punishable by a fine of no more than $250 or imprisonment for a term not to exceed 15 days, or both. Each license issued shall be evidenced by a tag, seal or other device approved by the Village Clerk. The license tag, seal or other device may be attached to the machine or held in the cash drawer for verification purposes. The continuation of a violation under this chapter shall constitute, for each day the violation is continued, a separate and distinct violation hereunder.

Every person licensed under the provisions of this chapter shall keep and, upon demand of any police officer or other lawful authority, produce the license issued to him/her.

Any license issued hereunder may be revoked by the Board of Trustees for proper cause.
