This chapter shall be known and may be cited as "Gasoline Service Stations and Motor Vehicle Repair Shops."

The Village Board of the Village of Blasdell hereby recognizes that gasoline stations in their operation can present special hazards to the public safety and welfare of the Village of Blasdell. Therefore, this chapter is enacted in order to protect the public health, safety and welfare by regulating the existing gas stations.

As used in this chapter, the following terms shall have the meanings indicated:

COMMERCIAL GARAGE
Any building, structure or lot which is used for the repair, maintenance or equipping of automobiles.
GASOLINE STATION
A building, structure or tract of land used for the storage and sale of gasoline, motor fuels, lubricants, accessories, supplies and any other materials related to the maintenance or equipment of automobiles or in which repairs, adjustments, maintenance or equipping of automobiles is conducted. The term shall include, without limitation, the rendering of the following services: fueling; changing oil, water, batteries or ties; replacing fan belts, air filters or oil filters; and installing windshield wiper blades or light bulbs. The term shall not include any such establishment which renders such services or stores such materials for a single commercial or industrial establishment rather than offering such services and materials to the public.
MAJOR REPAIR WORK
Repair work which does not consist of fueling; changing oil, water, batteries or tires; replacing fan belts, oil filters or air filters; installing windshield wiper blades or light bulbs; or such other minor repair and servicing functions as are prescribed by the Commissioner of Motor Vehicles under the Motor Vehicle Repair Shop Registration Act, Article 12-A of the State of New York Vehicle and Traffic Law, or any similar statute.

The following standards shall apply to all gasoline service stations and commercial garages located within the Village of Blasdell:

A. 

No major repair work shall be conducted outside to the structure.

B. 

All automobile parts and similar articles shall be stored within the structure.

C. 

No more than two dismantled vehicles, vehicles under repair, vehicles awaiting repair or repaired vehicles awaiting pickup shall be left in the area between the building line or front wall of a building and the front property line for more than 72 hours. In the case of a corner lot, the property shall be considered to have two front main walls and two front property lines.

D. 

The site shall be maintained so that vehicles using the station shall not obstruct or become a hazard to users of the public sidewalks or highways on which the station or garage fronts.

All gasoline service stations and commercial garages in the Village of Blasdell shall comply with the foregoing standards by NFPA No. 30.

A. 

Any Village Justice of the Village of Blasdell shall have jurisdiction to hear all signed complaints filed as hereinafter provided and all actions and proceedings hereunder and of all prosecutions for the violation of this chapter. Upon receipt by the Village Justice of any complaint regarding noncompliance with any section of this chapter, the Village Justice shall summon the alleged owner or operator to appear in person before him. If the summons is disregarded, the Village Justice may permit the filing of an information and issue a warrant for the arrest of such owner or operator.

B. 

Any person who observes the owner or operator of a gasoline service station or commercial garage violating any section of the chapter may file a signed complaint, under oath, with the Village Justice of the Village of Blasdell, specifying the objectionable conduct.

Violation of any provision of this chapter by any owner or lessee or other person shall constitute an offense, and each day's violation shall be deemed a separate offense punishable by a fine not exceeding $250 or imprisonment for not more than 15 days, or by both such fine and imprisonment.
