When used in this chapter, the following words shall have the meanings indicated:
All work is to be done by licensed plumbers.
A licensed journeyman plumber or master plumber employing plumbers shall be present at all times when work is being performed on any premises within the Village of Blasdell involving the original installations, alterations or repair of plumbing as defined in this chapter.
Training and experience.
If a licensed journeyman plumber or a master plumber has a certificate of competency from another municipality which indicates an equivalent combination of training and experience as indicated in Subsection C(1)(a) or (b) of Chapter 174, § 174-2, of the Village of Blasdell Code, the village then has the option of honoring that certificate.
Any person, firm or corporation who shall desire a license to conduct a plumbing business within the Village of Blasdell shall apply in person or, in the case of a firm or corporation, be represented by an officer of the corporation or member of the firm, at the office of the Village Clerk and register his or its name and address with the Village Clerk upon the application form prescribed by the Village Board.
The Village Clerk shall issue a license authorizing said applicant to conduct such business in the Village of Blasdell upon being satisfied that the applicant has met the following conditions:
Approval of the Village Board, evidenced by the receipt of a certificate from the Building Inspector showing that such person, a member of such firm or the superintendent of construction of such corporation has satisfactorily passed an examination. The certificate must be dated within one year of the date of the application.
Bond requirements. The applicant shall file with the Village Clerk a bond in the sum of $25,000 of an indemnity company, conditioned to indemnify and save harmless the Village of Blasdell of and from all damages and losses which may result from the work of said plumber, firm or corporation being done carelessly or imperfectly or in such a way that injury or loss results to persons or property thereby, or by reason of his failing to comply with all and singular the rules and regulations as now or may hereafter be established by the Village Board or Superintendent of Highways or with any ordinances of the village in relation to making excavations in the public streets or on private driveways or property or with any provisions of the ordinances of the Village of Blasdell.
Proof of financial responsibility. The applicant shall file with the Village Clerk certificates of insurance protecting the village to the extent of the following limits: personal liability of one hundred thousand dollars/three hundred thousand dollars ($100,000./$300,000.) and property damage liability of $50,000. In lieu of filing certificates of insurance, the applicant may post a surety or real property bond.
No license holder shall allow his name or license to be used by any other person or party either for the purpose of obtaining permits or doing any work under his license. Plumbers will be held responsible for the violation of any rules of the Village Board by journeymen plumbers or others while in their employ.
The forfeiture or suspension of the license of any plumber shall operate as the forfeiture or suspension of the license of a copartner, officers or employees of a corporation. A separate license will not be granted to any person employed by said partnership or corporation so long as the license of the offending plumber is under forfeiture or suspension and he continues to be associated with or employed by said partnership or corporation.
A license issued to a firm or corporation shall terminate upon the dissolution of said firm or corporation or upon the termination of employment of an officer or employee unless said corporation shall have in its employ another person duly licensed under this chapter who shall be employed by said corporation.
A license cannot be transferred to any successor in the business or to any person whomsoever under any circumstances.
All licenses shall expire on the 31st day of December of the year issued and may be renewed within 30 days preceding expiration.
A renewal license shall be issued by the Village Clerk each year to any person, firm or corporation holding a license at the expiration of the previous year, upon payment of the license fee as set by the Board of Trustees and filing a renewal of the required bond and proof of financial responsibility.
There shall be appointed as provided by law an Inspector or Inspectors of Plumbing, whose duties, in addition to those prescribed by law and those which may be prescribed by the Village Board and/or by the Building Inspector, shall be to inspect the construction and alterations of all plumbing work performed in the Village of Blasdell and to report, in writing, the results of such inspection of such plumbing to the Village Board, and he shall also report in like manner any person engaged in or carrying on the business of employing plumbers without having the license herein provided.
All plumbing must be completed in a building before attachment is made to the service pipe unless by special permit.
A deposit as set by the Board of Trustees is required, payable to the Village of Blasdell, when opening the streets, roads, sidewalks, etc.
All public street, road, sidewalk, etc., repairs will be the responsibility of the plumber who did said work.
All work in a street or other public place must be done in the best manner to protect the public against injury and to secure good and satisfactory work.
In either case, whether the service pipe is not previously connected to the street main or where it is laid to or inside the curb or continued to the cellar foundation for building purposes, a permit will be necessary for any additions thereto.
Plumbers will not be permitted to lay any kind of pipe or service line, new or replacements, between the stopcock and meter except with copper pipe, which shall be laid under the direction and according to the instructions of the Building Inspector or Superintendent of Public Works. Any copper rigid pipe (Type M or L) must be sweated with 15-5 solder.
No plumber will be permitted to make any connections with mains or distributing pipes.
Whenever any inspector or other person reports a violation of any rule or regulation for plumbing and drainage or a deviation from any officially approved plan or specification for plumbing and drainage filed with any board or department, the Village Board shall first serve a notice of the violation thereof upon the person, firm or corporation doing the work, if a registered plumber.
Such notice may be served personally or by mail, and if by mail, it may be addressed to such licensed plumber at the address registered by him or it with the Village Clerk, but the failure of a plumber to register will relieve the Board from the requirement of giving notice of violation. Unless the violation is removed within three days after the date of serving or mailing such notice, exclusive of the day of serving or mailing, the Village Board may proceed according to law. A reinspection fee as set by the Board of Trustees shall be charged.
Any person violating the provisions of this chapter or any rules or regulations of the village or Village Board and who fails to remove or correct such violations after notice of 10 days shall be guilty of a violation and, on conviction, shall be subject to a fine of not more than $250 or to imprisonment for not more than 15 days, or both, and in addition, if a licensed plumber, shall forfeit his or its license.
All violations under this chapter shall be prosecuted in the name of the Inspector on behalf of the Village of Blasdell.
Within the discretion of the Village Board and in lieu of criminal prosecution, the Board may conduct hearings on violations reported to it. Such a hearing shall be held before the full Village Board after first giving to the alleged violator five days' written notice of such hearing, which notice shall specify in detail the nature of the alleged violation. The decision of the Board shall be required to establish a violation.
In the event that a decision is rendered establishing a violation of this chapter, the Board may suspend the violator's license or revoke the same.
