Penalties for offenses. 

A. 

The words and phrases used in this chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them by the General Construction Law of the State of New York, except as herein otherwise expressly defined.

B. 

The following words and phrases shall have the meanings respectively ascribed to them in this section for the purposes of this chapter:

SWIMMING POOL
Any pool having a wall height or maximum water depth, whichever is greater, exceeding 18 inches.
WADING POOL
Any pool having a wall height or maximum water depth, whichever is greater, not exceeding 18 inches.

All swimming and wading pools in the Village of Blasdell which shall be moved, erected, constructed, excavated or placed either above, below or partly above and partly below grade level shall require a registration certificate in form prescribed by the Board of Trustees of the Village of Blasdell, in addition to a building permit when the same is required by other provisions of the Code.

A. 

All excavated pools of 1,500 cubic feet capacity and larger shall have a drain and each drain shall be covered by a grate four times the area of the drainpipe. The grate shall be removable only by the use of a hand tool.

B. 

All pools not covered under the provisions of Subsection A of this section shall be drained by controlled drainage. No pool, excavated or otherwise, shall be permitted to drain freely without control over volume and direction.

All inlet feed pipes shall be of the over-rim fill type at a minimum height of six inches above the overflow level of the water (six-inch minimum air gap).

No swimming pool, as defined in this chapter, shall be installed or maintained unless:

A. 

For an in-ground pool, there shall be erected and maintained a fence having a minimum height of four feet and a maximum height of six feet, so constructed that it will not shut off light or air to any building. Such fence shall completely surround the area of the swimming pool but shall be no less than three feet from any edge of the swimming pool placed on the lot line, and any gate shall be self-closing with a latch or lock. All latching and locking devices shall be at a minimum of four feet above the base of the fence. The wall of a dwelling and/or its accessory buildings may act as an integral part of the fence, but any openings or doors, etc., shall also be kept locked while premises are unsupervised by an adult.

B. 

An aboveground pool shall have either a lift-up or removal ladder with a self-containing fence above the pool. The alternative will be to fence in the entire pool area.

C. 

The wall of any dwelling and/or its accessory buildings may act as an integral part of the fence, but any openings or doors of said building or accessory buildings shall also be self-closing in nature and kept locked while premises are unsupervised by an adult.

The use of a megaphone, loudspeakers and public-address systems is prohibited in connection with the swimming pool herein regulated, and the use of any sound-producing or reproducing device, including human voices, shall comply with all provisions of this chapter and any other chapter of the Code of the Village of Blasdell.

A swimming pool may be erected or installed only as an accessory to a dwelling and for the private use of the owner or occupant and his family and guests.

A. 

Multiple dwelling units. Any swimming pool or any property having more than two family dwelling units shall comply with the provisions of this chapter in addition to any state and county regulations pertaining to public swimming pools.

B. 

Distances and percentage of area. Swimming pools shall not be erected nearer than five feet to the rear or side property line of the premises nor five feet to any dwelling and shall not occupy more than 10% of the total area of the premises.

C. 

Yard restrictions. No swimming pool shall be permitted in a required front or side yard as otherwise provided in this or any other chapter of the Code of the Village of Blasdell.

Any person who shall violate this chapter shall be guilty of an offense and, upon conviction, shall be subject to a fine of not more than $250 or to imprisonment for not more than 15 days or to both such fine and imprisonment. Each week's violation shall constitute a separate and additional violation. Notwithstanding the penalty hereinafter provided, the Village of Blasdell may enforce obedience to this chapter or any part thereof by injunction to restrain such violation.
