No development of land, including excavation, clearing of brush or laying out of roads shall be undertaken without fully complying with the requirements of these regulations.
When the Board finds, that because of unusual circumstances of shape, topography or other physical features of the subdivision tract, or because of the nature of adjacent developments, extraordinary hardship may result from strict compliance with regulations, it may vary the regulations so that substantial justice may be done and the public interest secured; provided, however, that no such variation shall be granted which will have the effect of nullifying the intent or purposes of these regulations or of any other statute, law or regulation of the State of New York, County of Erie or Town of Boston.
The Planning Board, in its discretion, is hereby empowered to approve cluster-type subdivisions, when permitted under the Zoning Law of the Town of Boston. Such subdivisions shall conform with Article XXVI (Supplementary Cluster Development Regulations) of the Zoning Law of the Town of Boston.[1]

Any person committing an offense against the provisions of this chapter shall be guilty of a violation, punishable by a fine of not more than $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.

Fees for applications for approval of a preliminary subdivision plat or a final subdivision plat shall be as set forth in the Schedule of Fees, as adopted by the Town Board of the Town of Boston.
