As used in this article, the following terms shall have the meanings
ascribed to them herein:
All such vehicles as defined in the Vehicle and Traffic Law of the
State of New York, and in addition thereto, minibikes, mopeds, snowmobiles
and all other recreational vehicles.
Any individual, partnership, unincorporated association or corporation.
The Town of Boston, Erie County, New York.
No person shall, between the hours of 11:00 p.m. of one day and 7:00
a.m. of the next day, park, stand, store or cause to be parked any motor vehicle
owned or controlled by said person, firm or corporation upon any Town or Erie
County highway as enumerated in Schedule A,[1] or any Town highway hereafter dedicated to the Town of Boston,
during the period of the year commencing with the first day of November until
the 31st day of March, both inclusive, of each year following the adoption
of this article.

A.
A vehicle pound as designated by the Town Board of the
Town of Boston shall be the place or places to which motor vehicles found
to be in violation of this article may be removed at the direction of a police
officer.
B.
Any motor vehicle in violation of any of the provisions
of this article, any ordinance or the Vehicle and Traffic Law of the State
of New York may be removed and conveyed by or under the direction of a police
officer, by means of towing or otherwise, to the Town vehicle pound. Such
removal shall be at the risk of the owner of the vehicle. Before the owner
or person in charge of the vehicle shall be permitted to remove the said vehicle
from the custody of the police at the Town vehicle pound, he shall furnish
evidence of his identity and ownership or right to possession and shall sign
a receipt for such vehicle and shall pay to the Clerk of the Town Justice
Court the sum of $60 for towing and the sum of $5 for each day or fraction
thereof during the time the vehicle remains in the pound.
C.
Instead of towing the vehicle to the pound, a police
officer may serve upon the owner or driver of the vehicle a summons.
A.
No person shall park, stand, store or leave a motor vehicle
upon any publicly or privately owned premises or property, parking areas or
parking lot without the consent and permission of the owner or lessee of such
premises.
B.
To effectuate the prohibition of parking on such premises
as above described, a conspicuous sign or signs shall be posted on such private
land, parking lots or parking areas informing the public as to the permitted
conditions of parking thereon or the prohibition thereof, together with a
reference to this article.
Any person who shall violate the provisions of this article shall be
guilty of a violation and, upon conviction thereof, may be punished by a fine
not to exceed $250. Each day that such violation continues may be considered
and constitute a separate violation.
