Uses and structures permitted in the M-1 District are as follows:
A. Principal uses and structures:
(1) Office buildings and other administrative, professional
or executive offices.
(2) Medical and/or dental buildings, clinics and laboratories.
(3) Trade or industrial schools, provided that such activity
is conducted wholly within an enclosed building.
(4) Research and development activities, including laboratories,
testing, small-scale experimental and pilot plant operations and production
operations incidental to research and development practice and techniques,
provided that all necessary safeguards are employed to prevent hazard or annoyance
to the community.
(5) The manufacture, compounding and assembly of products
from previously prepared materials including:
(a) Electrical and electronics components and equipment.
(b) Musical, scientific, medical, dental and photographic
equipment and supplies.
(c) Pharmaceutical products, cosmetics and toiletries.
(d) Recreational equipment and toys.
(e) Clothing and other textile products.
(f) Printing, publishing and engraving.
(g) Furniture and furnishings for households and offices
and related wood and metal products.
(h) Food and beverage products.
(6) Warehousing and wholesale distribution when conducted
within a completely enclosed building.
(8) Repair of trucks and licensed commercial vehicles, including
fabrication of miscellaneous parts and accessories.
B. Uses subject to special permit.
(1) Uses permitted by special permit in Article
XXIII.
(2) Increase in maximum height requirements in §
123-87.
(3) Radio or television transmission facilities and/or receive-only
antennas and mountings having a combined weight exceeding or equal to 50 pounds,
subject to the conditions and limitations of §
123-48B(1).

C. Accessory uses and structures:
(1) Accessory uses and structures customarily incidental
to permitted principal uses.
(2) Retail stores and services, restaurants and commercial
recreation occupying not more than 15% of the gross floor area of the principal
structure when incidental to the principal uses and planned and developed
as an integral part of the principal structure.
(3) Truck dispatch and transfer incidental to permitted principal
use, provided that no vehicle loading, unloading or parking shall be permitted
in a public right-of-way.
D. Limitations on permitted uses in the M-1 District:
(1) No use of land, building or structure shall be permitted,
the operation of which normally results in any:
(a) Fire or explosive hazard.
(b) Dissemination of atmospheric pollutant, noise vibration
or odor beyond the boundaries of the premises on which such use is located.
(2) No unneutralized refuse materials shall be discharged
into sewers, streams or ditches.
(3) Storage of flammable liquids shall be entirely underground
and in storage tanks approved by the New York State Uniform Fire Prevention
and Building Code. Safety containers shall be used within any building or
structure in which flammable liquids are handled.
(4) All side and rear lot lines abutting any lot in any R
District or a C-1 District shall be fenced and screened by plantings. Unless
otherwise provided, the fence shall be of a solid material approved by the
Town Board. Such fence shall not be more than 10 feet in height and shall
not project into any required front yard.
(5) Unless otherwise provided, required side and rear yards
shall be used only for landscaping and/or off-street parking of employees,'
customers' and visitors' cars.
Unless otherwise provided, the minimum lot size in the M-1 District
shall be specified in this section.
A. Lot area:
(1) The minimum size of any lot shall be one acre for all
permitted uses and structures.
B. Lot width at the building line:
(1) 100 feet for all principal uses and structures.
Unless otherwise provided, the maximum height of buildings in the M-1
District shall be as specified in this section.
A. Maximum: 30 feet, except on special permit by the Town
Board.
Unless otherwise provided, the minimum required yards and other open
spaces in the M-1 District shall be as specified in this section.
A. Front yard: 50 feet, except that, when opposite any R
District or when used for accessory parking, it shall be not less than 60
feet.
B. Side yards:
(2) Where a side yard abuts any R District boundary, it shall
be not less than 50 feet or the height of the principal building, whichever
is greater.
C. Rear yard:
(2) Where a rear yard abuts any R District boundary: the
same distance as for a side yard.
D. Maximum lot coverage: 40%.
