As used in this chapter, the following terms
shall have the meanings indicated, unless a different meaning clearly
appears from the context:
LOITERING
Remaining idle, essentially in or about one location; lingering;
remaining or waiting at one location; spending time idly; loafing
or walking about aimlessly in one vicinity or neighborhood; or "hanging
around."
PUBLIC PLACE
Any place to which the public has access and includes any
street, highway, road, alley or sidewalk. It also includes the front
or the surrounding area of any store, shop, restaurant, tavern or
other place of business and public grounds, areas and parks, as well
as parking lots or other vacant private property not owned by or under
the control of the person charged with violating this chapter or,
in the case of a minor, not owned or under the control of his/her
parent or guardian.
No person shall loiter in a public place. It
shall also be unlawful for a person to loiter in a public place in
such a manner as to create or cause to be created a danger of a breech
of the peace; to obstruct, hinder or impede the free passage of pedestrians,
patrons, vehicles or the general public; or to obstruct, molest, hinder,
impede or interfere with any person lawfully in any public place.
Any person who shall violate any provisions
of this chapter shall, upon conviction thereof, be sentenced to pay
a fine of not more than $500 and/or imprisonment for a term not to
exceed 120 days and/or any other penalty or fine provided by the Pennsylvania
Crimes Code.
