GENERAL REFERENCES
Sewers and water — See Ch. 197.
For the purposes of this chapter, the following words and phrases shall have the meanings ascribed to them in this section.
MUNICIPALITY
Any body politic, including but not limited to cities, towns, boroughs and townships, and shall include "person."
PERMIT
When used in connection with the Pennsylvania Department of Environmental Protection, the written permit issued by the Pennsylvania Department of Environmental Protection permitting the agricultural utilization of sewage sludge.
PERSON
Any institution, public or private corporation, individual, partnership or other entity.
SEWAGE ENFORCEMENT OFFICER
The legally designated authority of the Township of Allegheny, or his/her authorized representative.
SEWAGE SLUDGE
The precipitated solid matter produced by water and sewage treatment processes.
It shall be unlawful for any person to use or continue to use their land, or any other land within the Township, as a sewage sludge disposal area, without first complying with the following:
A. 
Any person who is desirous of using any land within the Township as a sewage sludge disposal area must first register with the Township Sewage Officer and submit proper documents to the satisfaction of the Sewage Enforcement Officer that he has met and has complied with all Department of Environmental Protection requirements. The said documents to be submitted to the Sewage Enforcement Officer for his records must contain the following information:
(1) 
Name and address of disposer.
(2) 
Soil maps and topographic maps which shall show site boundaries and sludge application areas.
(3) 
The applicant shall submit a brief statement denoting the source of the sewage sludge, the proposed application rate per acre and the total amount to be applied during the period.
(4) 
The applicant shall submit a chemical analysis of the sewage sludge to include, but not be limited to, the ranges of the following: moisture content, percent total nitrogen (moist and dried), percent ammonium (NH4 - N) (moist and dried), percent organic nitrogen (moist and dried), BOD, pH and the following reported on a dry-weight basis: cyanide, sodium, cadmium, zinc, copper, nickel, lead, chromium, mercury, and molybdenum and other toxic substances and enteric pathogens.
(5) 
The applicant shall also furnish with the application a certified copy of the Pennsylvania Department of Environmental Protection permit to indicate that all Pennsylvania Department Environmental Protection regulations governing sewage sludge disposal have been complied with, or a brief statement from the Pennsylvania Department of Environmental Protection that it has no permit requirements.
(6) 
A brief statement indicating the method of disposal of sewage sludge, and the purposes for which the sewage sludge disposal will serve.
(7) 
A brief statement indicating the source of the sewage sludge and, when the source is other than solely residential, a statement from the generator that the sewage sludge is suitable for the purposes hereinafter recited.
(8) 
The name and address of the landowner of the land where the sludge is to be disposed of, indicating his desire to have his land so utilized.
The disposal of sewage sludge as regulated by this chapter shall apply only to agricultural utilization of the sludge, and to land reclamation utilization, or land disposal. all other uses for sewage sludge are unlawful and are prohibited in the Township of Allegheny.
After the Sewage Enforcement Officer has in his possession all the documents and information as required by § 202-2, the Sewage Enforcement Officer shall then review all the documents and information, and also review the site that is to be used, and, after so doing, shall make a recommendation to the Township Supervisors with regard to the proposed sewage sludge utilization.
A. 
The recommendation to be made by the Sewage Enforcement Officer shall not be made less than 10 days after the disposer has complied with all the terms of § 202-2 nor more than 20 days after such compliance.
B. 
After the recommendation is made to the Township Supervisors by the Sewage Enforcement Officer, the Supervisors shall, at their next regularly scheduled monthly meeting, either approve or disapprove the proposed sewage utilization.
If approval is granted pursuant to § 202-4 by the Township Supervisors, the person disposing of sewage sludge as permitted by this chapter shall, every 12 months after the date of the approval, submit to the Sewage Enforcement Officer verification from the Department of Environmental Protection that all Department of Environmental Protection regulations concerning sewage disposal have been met and no violations have taken place during the course of the year.
A. 
The Sewage Enforcement Officer is hereby authorized and directed to make such inspections as are necessary to determine satisfactory compliance with this chapter.
B. 
It shall be the duty of the owner or occupant of a property to give the Sewage Enforcement Officer free access to the property at reasonable times for the purpose of making such inspections as are necessary to determine compliance with the chapter.
Any person who violates any provision of this chapter shall, upon conviction, be punished by a fine of not less than $100 nor more than $300, and each day's failure to comply shall constitute a separate violation.
