The purpose of this chapter is to promote efficient,
logical, orderly and harmonious future property development in the
Township of Allegheny and to further promote the health, safety and
general welfare of the Township residents and to provide for a proper
disposition of stormwater drainage which will not be to the detriment
of property owners located downgrade.
It shall henceforth be unlawful for any person,
partnership, corporation, authority or entity to attach any pipe onto
the outfall end of any Allegheny Township stormwater catch basin or
stormwater drain for any purpose whatsoever without securing a permit
therefor from the Allegheny Township Board of Supervisors.
The applicant shall secure an application from
the Allegheny Township Manager and complete said application, supplying
to the Allegheny Township Manager all requested information and documentation
together with a fee of $25 which is nonrefundable and a deposit of
$500 to be utilized for payment of engineering and legal services
rendered to the Township in the processing of the application with
any balance remaining to be refunded to the applicant together with
an itemized bill for the amount not refunded. The applicant must produce
a Pennsylvania stream encroachment permit or evidence that a Pennsylvania
stream encroachment permit is not required, and the applicant must
also secure and produce any other permits which may be required by
any applicable statutes, ordinances or regulations.
The applicant shall submit, in quadruplicate,
a plot plan showing the location of the existing Township stormwater
catch basin or stormwater drain outfall, together with the location
of the proposed extension, together with the outside dimensions of
the property over which the proposed extension will be constructed.
The plot plan will be of sufficient detail to enable a legal description
to be prepared, by metes and bounds, of a fifteen-foot right-of-way
over the subject property for the storm drain extension.
The Township Engineer shall, prior to any construction,
inspect the proposed construction site and make construction recommendations
such as the preparation of a construction detail, installation of
a catch basin at the outfall end of the storm drain extension, a suggestion
for construction of retention ponds and any other recommendations
deemed necessary by the Township Engineer, all of which recommendations
shall be complied with by the applicant during the construction process.
The Township Engineer shall make as many interim construction inspections
as deemed necessary by said Township Engineer and shall make a final
inspection of the construction site after construction is completed
and shall report the findings of his inspections to the Allegheny
Township Board of Supervisors.
After completion of the permitted and inspected
construction, any subsequent or new extension of the then-existing
stormwater drain by any person, partnership, corporation, authority
or entity shall be unlawful without again complying with all of the
terms and conditions of this chapter.
The applicant, upon the completion of construction,
shall post a two-year maintenance bond in a form approved by the Township
Solicitor and in an amount established by the Township Engineer running
to the Allegheny Township Board of Supervisors and guaranteeing the
quality of workmanship and materials to be free of defects for a period
of two years after completion of construction.
The applicant shall notify all property owners
who own property within 500 feet of the outfall end of the proposed
stormwater drain extension of the proposed project and its nature,
character and expected impact on the property of said downgrade property
owners. The applicant shall file with the Board of Supervisors a statement,
under oath, indicating the names and addresses of those notified,
the method of notification and the general contents of the notice.
After completion of construction, the owner
or owners of the real estate over which the storm drain extension
has been constructed shall convey a right-of-way of at least 15 feet
in width and centered on the extension pipe to the Township of Allegheny
for public purposes and for the purpose of entry, maintenance and
repair to the stormwater drain extension pipe.
Any person violating any of the provisions of
this chapter shall, upon conviction therefor before any District Justice,
pay a fine up to $300 and/or undergo imprisonment for a period of
30 days, or both.
