The official title of this chapter is the "Allegheny Township
Zoning Ordinance."
This chapter is adopted by virtue of the authority granted to
the Township by the commonwealth in the Pennsylvania Municipalities
Planning Code, Act 247 of 1968, as amended by Act 170 of 1998 (53
P.S. § 10101 et seq., as may be amended from time to time).
In the event of conflicts between the provision of this chapter
and any other ordinance or regulation, the more restrictive provisions
shall apply. In their interpretation and application, the provisions
of this chapter shall be considered minimum requirements adopted for
the promotion of the health, safety and general welfare of the public.
In interpreting the language of this chapter to determine the extent
of the restriction upon the use of the property, the language shall
be interpreted, where doubt exists as to the intended meaning of the
language written and enacted by the Township Supervisors, in favor
of the property owner and against any implied extension of the restriction.
Community development objectives are set forth in the Southwest
Regional Development Comprehensive Plan for Allegheny Township prepared
by Simonds and Simonds in 1967-68 and the Strategic Long-Range Comprehensive
Plan for Allegheny Township as adopted by the Allegheny Township Board
of Supervisors in 1997. In addition to the specific objectives stated
in the Township's Comprehensive Plan, the general community development
objectives on which this chapter is based are:
A. The promotion and protection of the public health, safety and welfare
of the residents of the Township and of the public, generally;
B. The encouragement and facilitation of orderly community growth and
development;
C. The protection of the character of and the maintenance of the stability
of the residential, commercial and industrial areas within the Township;
D. The provision of adequate light, air, amenities and access to properties;
E. The guidance of development in order to provide adequate and economical
community facilities and utilities;
F. The division of the Township into various zoning districts restricting
and regulating therein the location, construction, alteration and
use of buildings, structures and land;
G. The prevention of overcrowding or incompatible development or use
of land and the prevention of blighting conditions, congestion and
hazard in travel and transportation;
H. The conservation and stabilization of property values through encouragement
of the most appropriate use of land in relation to adjacent land uses;
I. The promotion of conservation of the environment and other natural
and historic features;
J. The preservation of the low-density residential and agricultural
character of the Township; and
K. The support of related strategies as identified in the Township's
Comprehensive Plan.
No structure shall be located, erected, constructed, reconstructed,
moved, structurally altered, converted or enlarged, nor shall any
structure or land be used or be designed to be used, except in full
compliance with all the provisions of this chapter and after the lawful
issuance of all permits and certificates which may be required by
this chapter.
This chapter, including the Zoning District Map, together with
any succeeding amendments thereto, shall be on file and shall be available
for public inspection in the Allegheny Township Community Building.
