The Council hereby signifies its intention and desire to organize an Authority under the provisions of the Municipality Authorities Act of 1945, as amended.[1]

Editor's Note: See 53 P.S. § 301 et seq. Section 3 of this ordinance directed the proper city officers to cause notice of the substance of the ordinance, including that of the Articles of Incorporation, and of the proposed filing of the Articles to be published one (1) time in a newspaper published and of general circulation in the county. Section 4 directed the Mayor and City Clerk to file the Articles, together with necessary proof of publication, with the commonwealth and to do all other acts and things necessary to effectuate incorporation of the Authority. Section 6 stated the names and addresses and terms of office of the first members of the Board of the Authority.

The Mayor and the City Clerk are hereby authorized and directed to execute on behalf of the City of Bradford Articles of Incorporation for said Authority, in substantially the following form:
Articles of Incorporation
To the Secretary of the Commonwealth
Commonwealth of Pennsylvania
  In compliance with the requirements of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended, the City of Bradford, McKean County, Pennsylvania, desiring to incorporate an Authority thereunder, does hereby certify:
A.
The name of the Authority is Bradford Sanitary Authority.
B.
Said Authority is formed under the provisions of the Act of May 2, 1945, P.L. 382, as amended.
C.
No other Authority organized under the Act of May 2, 1945, P.L. 382, as amended, or under the Act of June 28, 1935, P.L. 463, as amended, or under the Act of June 5, 1947, P.L. 458, as amended, is in existence in or for the incorporating municipality, the City of Bradford, except that the City of Bradford, the County of McKean and the Townships of Foster, Bradford and Lafayette and the Borough of Lewis Run have jointly organized the Bradford District Flood Control Authority and the City of Bradford has also organized the Bradford Parking Authority and Bradford City Water Authority.
D.
The name of the incorporating municipality is City of Bradford, McKean County, Pennsylvania.
E.
The names and addresses of its municipal authorities are as follows.[1]
F.
The Board of the Authority shall consist of seven (7) members, which members shall be appointed by the City Council of the City of Bradford, the incorporating body. Any vacancies on said Board which shall occur by reason of the death, resignation or otherwise of any member shall likewise be filled by appointment by the City Council.

The names, addresses and terms of office of the first members of the Board of the Municipal Authority to be formed hereby are as follows.[2]

Proof of publication of the advertisement of notice of filing these Articles of Incorporation is submitted herewith.[3]

The initial project to be undertaken by said Authority is to acquire, hold, construct, improve, maintain, operate or lease, either in the capacity of lessee or lessor, sewers, sewer systems or parts thereof and sewage treatment works, including works for treatment and disposal of industrial waste and facilities and equipment for the collection, removal or disposal of ashes, garbage, rubbish and other refuse materials by incineration, landfill or other methods, for the City of Bradford and for such other territory as it may be authorized to serve.
