The Pennsylvania Electric Company shall have the right at all times
to supply such persons as may desire the same with light and power by means
of electricity at such prices as may be agreed upon, together with the right
to make, erect and maintain the necessary buildings, machinery and apparatus
for manufacturing and distributing the same.
Said company shall also have the right to use the streets, lanes and alleys of said city for the purpose of erecting and maintaining such poles, wires and other apparatus as may be necessary in order to transact the business as mentioned in §
A228-32 of this ordinance.
The rights and privileges hereby conferred are granted to the Pennsylvania
Electric Company and its successors for the term of ten (10) years from the
first day of July 1967, provided that nothing contained in this ordinance
shall be construed as granting any exclusive privileges to said Pennsylvania
Electric Company either to occupy the streets, lanes and alleys of said city
by the erection of poles, wires and other necessary apparatus or of supplying
the City of Bradford and such other persons, partnerships or corporations
as may desire light and power; and provided, further, that the City of Bradford
hereby expressly reserves unto itself the right and privilege at any time
during the existence of this franchise of supplying itself with electric or
other light for its streets and buildings and of furnishing electric or other
light and power to such persons, firms, companies or corporations in the City
of Bradford as may desire the same, upon such terms and conditions as may
be agreed between the city and persons, firms, companies or corporations so
desiring such light and power, and of making, erecting and maintaining the
necessary machinery and apparatus for manufacturing the same.
Said company shall at all times be subject to such reasonable rules,
regulations and ordinances as the Council of said city may prescribe affecting
its business and operations within the limits of said city.
This permission is hereby granted with the express understanding that
said company shall be responsible for and save the City of Bradford harmless
from all loss or damage accruing to any person, partnership or corporation
that may be injured by reason of its operations or by the maintenance of its
poles and wires and other apparatus upon the streets, lanes and alleys of
the City of Bradford and with the further understanding that said company
shall cause as little inconvenience to the public in the City of Bradford
in the use of the streets, lanes and alleys occupied by its poles and wires
as possible, under penalty of forfeiture of the rights and privileges hereby
conferred.
