The following restrictions shall apply concerning any tree within a public right-of-way in the Town of Charlestown:
A. 
No person shall whether by misfeasance or malfeasance damage, cut or transplant any tree, attach wire, nails, advertising poster or other contrivance to any tree; allow any gaseous, liquid, chemical or solid substance that is harmful to trees to come in contact with them; or set fire or permit any fire to burn when such fire or the heat thereof shall injure any portion of any tree without first obtaining a permit from the Tree Warden.
B. 
No person shall with knowledge and intent deposit, place, store or maintain any stone, brick, sand, fill material, concrete or other material that impedes the free passage of water, air or fertilizer to the roots of any tree growing therein, except by written permit from the Tree Warden.
C. 
No person shall preclude the percolation of water or nutrients and gaseous exchange vital to a tree's survival by placing any impervious materials within the confines of the tree well opening.
D. 
No person shall with knowledge and intent move any building or any other large object that may injure public trees or parts thereof without first obtaining the written approval of the Tree Warden.
E. 
All trees within the public rights-of-way that are within thirty (30) feet of any excavation or construction of any building or structure or non public-safety related tree work shall be guarded through the length of the project with good substantial fence, frame or box not less than four feet high. The owner(s) of the property where the excavation or construction occurs shall be responsible for compliance with this provision of the ordinance and shall be required to give notice of said activity to the Tree Warden prior to performance of the work.
A. 
Any person desiring to plant a tree within the public rights-of-way must first obtain a written permit from the Tree Warden. Any permit shall be granted date certain and shall include consideration of appropriateness of species, location, size and public safety.
B. 
Tree planting by persons other than the Tree Warden or his/her agents, the proposed method and quality of work for planting as prescribed by the Tree Warden shall be adhered to.
