The illegal dumping of rubbish and refuse material upon private and public properties is already prohibited by law. As a result of the current solid waste crises and the resulting increased legal disposal fees, this form of land pollution to our environment has increased significantly and must be brought under control.
As used in this chapter, the following terms shall have the meanings indicated:
Decaying or nondecomposable solid waste materials, consisting of all combustible and noncombustible solid wastes. It includes garbage and rubbish but does not include sewage.
Combustible or noncombustible solid waste material, except garbage and sewage, including but not limited to such materials as paper, rags, cartons, boxes, wood wastes, rubber, leather, tin cans, metals, mineral matter, glass, crockery, dust, ashes, construction wastes, industrial wastes, demolition wastes, agricultural wastes, abandoned vehicles, street sweepings, bulky wastes, the residue from the burning of wood, coal, coke or other combustible materials and any other unwanted or discarded material.
Any individual, firm, corporation or other entity who or which places or causes to dump illegally any rubbish or refuse material on public or private properties in the Town of Belchertown shall be fined, upon conviction, not less than $50 nor more than $1,000 for each offense. The Board of Health may also enforce this chapter pursuant to the noncriminal disposition procedure.[1] There shall be no warnings issued or waiver of penalties. The party responsible shall incur all legal disposal costs for cleaning and legal disposal of rubbish and refuse.
This regulation shall become effective the day the publication is in a local newspaper.
