Township of Bridgewater, NJ Chapter 150 Parks and Playgrounds: Curfew

§ 150-1 Hours open.

The parks and playgrounds shall be formally open daily to the public from sunrise to one hour after sunset and also during those times when sponsored activities are conducted by the Township of Bridgewater Department of Recreation and Parks.

§ 150-2 Loitering after hours unlawful.

It shall be unlawful for any person to remain idle or loiter in any park or playground between one hour after sunset and sunrise or when the parks and playgrounds are not formally open to the public aforesaid.

§ 150-3 Nonapplicability to county parks and playgrounds.

The provisions of §§ 150-1 and 150-2 of this chapter shall not apply to any park, playground or golf course in this Township which is operated by and which is under the jurisdiction and control of the Somerset County Park Commission.

§ 150-4 Parks and playgrounds owned by adjacent municipalities.

The provisions of §§ 150-1 and 150-2 of this chapter shall not apply to any park or playground owned by an adjacent municipality and which is under the jurisdiction and control of any board or body of such adjacent municipal owner.

§ 150-5 Responsibility of parents or guardians.

It shall be unlawful for the parent, guardian or other adult person having the care or custody of any minor under the age of 18 years to knowingly permit such minor to remain idle or loiter in violation of § 150-2 of this chapter.

§ 150-6 Arrest of minors: notification of parents.

Whenever any minor under the age of 18 years is arrested for violating § 150-2 of this chapter, the Chief of Police of the Bridgewater Township Police Department shall notify the parent, guardian or other person having custody of such minor of such arrest.

§ 150-7 Presumption of knowledge of violation.

If it be established that any minor under the age of 18 years remained idle or loitered in violation of § 150-2 of this chapter, then it shall be presumed, in the absence of proof to the contrary, that the parent, guardian or other adult person having the care or custody of such minor knowingly permitted such minor to do so.

§ 150-8 Presumption of consent to subsequent violation.

If it be established that the parent, guardian or other adult person having the care or custody of any minor under the age of 18 years was duly notified pursuant to § 150-6 of this chapter that such minor had been arrested for violation of § 150-2 of this chapter, and it be further established that such minor subsequently remained idle or loitered in violation of § 150-2 of this chapter, then it shall be presumed, in the absence of proof to the contrary, that such parent, guardian or adult person knowingly permitted such subsequent violation.

§ 150-9 Violations and penalties.

Any person or persons violating any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment in the Somerset County Jail for a term not exceeding 90 days, or by both such fine and imprisonment, in the discretion of the court.
