The Board of Trustees of the Village of Ballston Spa hereby finds that excessive uniformity, dissimilarity, inappropriateness or poor quality of design in the exterior appearance of buildings erected in the business districts adversely affects the desirability of the area and neighboring areas. It is the purpose of this section to prevent these and other harmful effects of such exterior appearances of buildings erected in the business districts and thus to promote the health, safety, comfort and general welfare of the community, to promote the public convenience and prosperity, to conserve the value of buildings and to encourage the most appropriate use of land.
A. 
Any renovation, alteration, construction or change to the exterior facade of a structure within the Village of Ballston Spa's business districts shall require a building permit. Said plans shall first be reviewed with the Building Inspector to determine if the proposed facade is compatible with the surrounding buildings. In making such determination, the Building Inspector shall compare said plans with the design criteria adopted by the Village Board of Trustees, as may be amended from time to time. Said criteria may be obtained at the Village Hall for review.
B. 
Prior to the construction, alteration or repainting of any exterior facade on a structure within the business districts, the owner must provide plans of the proposed color scheme. Said colors must be chosen from the Appropriate Period Colors Chart on file with the Village Clerk. Said chart may, by resolution, be amended by the Village Board from time to time as it sees reasonable. No work shall be performed without the Building Inspector's approval.

C. 
In the event that the applicant and Building Inspector cannot agree on the design of the facade, such application shall be denied and forwarded to the Village of Ballston Spa Planning Board, which is hereby charged with the responsibility of administering and carrying out the intent of this article and shall have all the powers envisioned in § 205-23 of this chapter.
A. 
Any application referred to the Planning Board by the Building Inspector pursuant to § 205-85B shall be made on a form provided by the Village in accord with § 205-21.
B. 
The Board may approve, conditionally approve subject to specified modifications, or disapprove any application for a building permit referred to it by the Building Inspector.
C. 
The Planning Board may impose appropriate conditions and safeguards in connection with its approval.
