No new street, boulevard, highway or public way shall be laid out or offered for acceptance as a public thoroughfare in the Town which shall not conform to the specifications as provided in this article. No person owning any tract or parcel of land within the Town, or having any interest therein, shall lay out or construct any streets, boulevards, highways or public ways over, upon or though that land which is designed or intended as public thoroughfares, except in the manner and in accordance with the rules and regulations prescribed in this article.

Any person desiring to lay out and construct any proposed streets, boulevards, highways or public ways shall file with the Town Engineer at least four copies of a preliminary plan or survey, at a scale of one inch equals 100 feet, showing the location and width of all such proposed streets, boulevards, highways or public ways to be constructed thereon, together with their relationship to any existing highways abutting or adjoining such premises. Such plan shall also show any proposed building lots intended to be laid out upon the tract or parcel of land, which lots must conform to all zoning regulations[1] of the Town as to lot area and street frontage. There shall also be filed with the preliminary plan four copies of a profile map, which shall be upon tracing cloth, of each proposed street, boulevard, highway or public way and which shall be at the scale of one inch equals 40 feet horizontal and four feet vertical, referred to the Town datum plans showing the existing center-line elevations with a light solid black line, the east or north street-line elevations in a dotted line and the west or south street-line elevations in a dashed line, all at points 50 feet apart. The Town Engineer shall thereupon examine the plan and profiles as to its engineering features and may make such alterations or recommendations as he shall deem necessary to make the street properly fit into the Town Plan or to provide proper and necessary drainage. He shall then submit the plan and profiles to the Town Planning and Zoning Commission, which after proper examination and investigation, if it approves the layout and the proposed line and grades, shall forward its report in writing to the Town Council, and the Town shall be required to give final approval to the lines and grades. No street shall be proposed which shall be less than 60 feet in width, except upon the recommendation of the Planning and Zoning Commission, and it shall give its reason therefor in writing. Dead-end streets shall not be permitted except where circumstances make them absolutely necessary, in which case a turnaround having an outside radius of not less than 35 feet shall be provided. The Town Council shall act upon the Planning and Zoning Commission's recommendations at their first regular meeting following delivery of such recommendations to the Town Council.

Upon final approval of the proposed lines and grades by the Planning and Zoning Commission, the owner of the land through which the streets are to be laid out or constructed shall immediately file with the Mayor a good and sufficient surety bond, procured from a surety company of good standing and authorized to do business in the state, in such an amount or amounts as the Mayor shall deem sufficient to save the Town harmless, conditioned upon the faithful performance of the construction in accordance with the approved lines and grades and other Town specifications at their sole expense and without cost to the Town.
A. 
The owner shall lay out and grade the streets, boulevards, highways and public ways, their entire width and length, in accordance with such approved grades and lines and shall grade a roadway at least 32 feet wide, centered between the street lines and having a crown of 1/40 to 1/60 of the roadway width, as the Town Engineer or his representative shall direct. A pavement width in excess of 32 feet may be required when deemed necessary by the Planning and Zoning Commission. All excavations shall be made in conformity with the plans and the slopes of earth cuts or fills and shall be neat and true to the lines shown on the plans or as ordered.
B. 
Subgrade. All soft and yielding material and other portions of the subgrade which will not compact readily when rolled shall be removed, and all rock or boulders over five inches in size found in the earth shall be removed or broken off to a depth of not less than one foot below subgrade. All holes or depressions made by the removal of material as described shall be filled with suitable material and the whole surface compacted uniformly by rolling the entire area with a three-wheel power roller weighing not less than 10 tons. The rolling shall be continued until the entire subgrade is uniformly and thoroughly compacted, true to established lines and grades. The finished subgrade shall be checked and approved by the Town Engineer or his representatives prior to the placing of base material.
C. 
All ditches and drains approved by the Director of Public Works shall be completed sufficiently to drain the highway effectively before the placing of any construction material shall be permitted.
D. 
Base.
(1) 
The base shall consist of a two-course foundation of clean bank-run gravel, with maximum stone size not exceeding four inches in diameter, constructed on the prepared subgrade in conformity with the lines and grades with a compacted thickness of 12 inches. All base material used must be approved prior to placing by the Director of Public Works or his representative.
(2) 
The gravel for the first or bottom course shall be spread upon the prepared subgrade to a depth not to exceed six inches when compacted. The material shall then be wetted and rolled with a power roller weighing not less than 10 tons and the wetting and rolling continued until this course is thoroughly compacted to a firm, even surface. The second or top course shall then be spread to such a depth that the base will have a total depth of 12 inches after final rolling. This course shall be shaped, wetted and compacted as specified above until thoroughly compacted to a firm, even surface; the rolling and wetting shall be continued until all voids are filled and a slight wave of excess water and sand forms a grout in front of the roller wheels, after which this portion may be left to dry. The surface shall be rerolled and sprinkled on succeeding days as may be necessary to maintain a thorough bond until the wearing surface is placed.
E. 
Pavement. Upon the prepared base shall be applied a two-inch (after compaction) wearing course of bituminous concrete. The material shall conform to Connecticut State highway specifications for Type 109F or 120F dense grades bituminous concrete. The temperature of the mixture when placed shall be between 250° and 300° F. The mixture shall be spread with an approved mechanical spreader. The mixture, after spreading, shall be rolled with a tandem power roller weighing not less than 10 tons. Roller wheels shall be equipped with scraping and sprinkling devices and shall be properly moistened without excess water. Rolling shall start longitudinally at the sides and proceed toward the center. It shall then be cross-rolled with a three- to five-ton roller. Placing the material shall conform to Connecticut State highway standard specifications for dense graded bituminous concrete pavement.
F. 
Curbing.
(1) 
Curbing shall consist of machine-laid bituminous concrete lip curbing constructed on the pavement to the dimensions and details shown on the plans or as ordered. Materials for this work shall be the same dense graded bituminous concrete used for the pavement. Construction methods for this work shall conform to Connecticut State Highway Department specifications for machine-laid bituminous concrete lip curbing.
(2) 
The owners shall also, at their own expense, set all necessary stone or concrete monuments at least six inches by six inches in size at all street corners and angles in the street lines. The tops of such monuments shall be set to the established grade.

Upon the completion of the work to the satisfaction and approval by the Town Engineer and Director of Public Works, the Mayor shall certify to the Town Council that the various regulations have been complied with and that the streets, boulevards, highways or public ways are in proper condition for formal acceptance by the Town Council as public thoroughfares. If the Town Council votes to accept such streets, it shall act by formal resolution, which resolution shall set forth the width and approximate length of the streets accepted, together with a designation of the name by which the streets shall thereafter be known.
Any person who shall willfully violate any of the provisions of this article shall be fined not more than $100.
