A.
It shall be mandatory for all persons who are owners, lessees and occupants of residential property to separate recyclable material from all other solid waste produced by such residence, including leaves, glass bottles and jars, tin and bimetal cans, pourable plastic containers (Nos. 1 and 2), aluminum beverage containers, corrugated cardboard, clean mixed paper and newspapers as hereafter defined and any other materials as mandated by the Monmouth County Solid Waste Management Plan for collection and ultimate recycling of said materials as set forth in § 253-4 of this chapter.

B.
It shall be mandatory for all owners, schools, lessees and occupants of business and industrial property and of private, public and governmental institutions and buildings to separate recyclable material from all other solid waste produced by said nonresidential establishments, including leaves, glass bottles and jars, aluminum beverage containers, corrugated cardboard, clean mixed paper, newspapers, tin and bimetal cans, pourable plastic containers (Nos. 1 and 2) and any other materials as mandated by the Monmouth County Solid Waste Management Plan for collection and the ultimate recycling of said material as set forth in § 253-4 of this chapter.

C.
On and after October 1, 1988, no one shall be permitted
to place any demolition materials with other solid waste for landfill
disposal.

E.
On and after the adoption of this chapter, and in
accordance with existing state regulations (N.J.A.C. 14A:3-11), all
service stations, oil retailers and motor vehicle reinspection stations
with used oil holding tanks shall accept up to five gallons at a time
of used motor oil from individuals changing oil from cars, lawn mowers
or motorcycles and shall post a sign informing the public that they
are a "Used Oil Collection Site."
F.
Grass clippings, white goods, rechargeable batteries,
vehicle batteries, and asphalt shingles shall not be disposed with
mixed household or commercial trash.

G.
Residents, businesses and institutions shall use only those recycling haulers and/or facilities registered with Monmouth County. Failure to comply with this requirement may result in the issuance of fines in accordance with § 253-9 of this chapter.
H.
Businesses, institutions and multifamily housing complexes
not served by the municipal recycling collection program shall arrange
for proper separation, collection and disposition of mandated recyclables
and shall provide the Municipal Recycling Coordinator with the name
and address of the company providing solid waste and recycling collection
services.

I.
Businesses or institutions hauling their own recyclables
shall provide the Municipal Recycling Coordinator with quarterly reports
on the quantity and destination of recyclables.
J.
All applicants seeking construction or demolition
permits shall identify all disposal and recycling arrangements. All
applicants shall provide records documenting the quantity and disposition
of all materials.
As used in this chapter, the following terms
shall have the meanings indicated. Any term not defined below shall
be given its regular and normal meaning.
Includes aluminum containers used for soda, beer or other
beverages.
Includes the white and/or off-white stationery, photocopy
and computer paper, magazines, periodicals, soft cover books and paperbacks,
used envelopes, junk mail and chipboard (cereal boxes).

Includes cardboard of the type used to make cardboard boxes,
cartons, pasteboard and similar corrugated and draft paper material.
Includes all asphalt, concrete, tree stumps, brush, land
clearing debris, pallets, waste lumber and other materials generated
from construction and demolition projects, scrap metal, metal appliances
or other bulk material, items larger than one cubic foot and/or five
pounds.

Includes all products made from silica or sand, soda ash
and limestone, the product being transparent or translucent and being
used for packaging or bottling of various matters, excluding, however,
blue or flat glass commonly known as "window glass."
Includes paper of the type commonly referred to as "newsprint"
and inserts that come with the paper.

Containers made of Class 1 or 2 polyethylene teraphthalate
and bearing the symbol for PET Class 1 or 2 plastics.

Includes all garbage and rubbish normally produced by the
occupants of commercial, industrial and residential property and disposed
of by private or public pickup.
Includes all disposable items made of tin, steel, or a combination
of metals, including containers commonly used for the storage of food
products.
Includes refrigerators, freezers, air-conditioning units,
humidifiers, and other appliances containing CFCs or HCFCs, ranges,
stoves, dishwashers, washing machines, clothes dryers, hot-water heaters,
and similar large household appliances.

A.
The position of Municipal Recycling Coordinator is
hereby created and established within the Township of Freehold.
B.
The Municipal Recycling Coordinator shall be appointed
by the Township Administrator pursuant to the Civil Service Laws of
New Jersey and in accordance with the Monmouth County Solid Waste
Management Plan.

The Township Committee, or the Municipal Recycling
Coordinator subject to the approval of the Township Committee, shall
establish and promulgate reasonable rules and regulations as to the
manner, days and times for collection, sorting, transportation, sale
and/or marketing of said recyclable material in order to encourage
the preservation of material resources while minimizing the cost of
the recycling program to the Township of Freehold. The rules and regulations
provided for hereunder shall be adopted by resolution of the Township
Committee. Copies shall be maintained in the office of the Township
Clerk and be available for inspection and/or purchase. No later than
November 30 of each year, the Municipal Recycling Coordinator shall
submit a certified copy of the current rules and regulations as well
as a certified copy of this chapter to the Monmouth County Recycling
Coordinator for review and comment by county planning and enforcement
staff.
A.
The Township Committee may use municipal personnel
to collect residential recyclable material set forth herein at curbside
and/or from a dropoff center and shall sell said recyclable material
if a market exists therefor pursuant to N.J.S.A. 40A:11-1 et seq.
B.
The Township Committee may elect to enter into agreements
with any person, partnership, corporation, or municipality authorizing
him or it to collect said recyclable material at curbside or from
a dropoff center and to sell said recyclable material.
A.
Recyclable material as defined herein shall be the
property of the Township of Freehold once placed on the curbside or
brought to a dropoff center.
B.
It shall be a violation of this chapter for any person
unauthorized by the Township of Freehold to pick up or cause to be
picked up said recyclable material as defined herein. Each such collection
in violation hereof shall constitute a separate distinct offense punishable
as hereinafter provided.

Anything herein to the contrary notwithstanding,
any person, partnership or corporation who or which is the owner,
lessee or occupant of a residential or nonresidential property may
donate or sell said recyclable material as defined herein to any person,
partnership or corporation whether or not operating for profit. Said
person, partnership or corporation, however, shall not pick up said
recyclable materials at curbside or at a municipal dropoff center.
Any person or entity using a direct disposal method, and any person,
partnership or corporation engaging in the business of direct disposal,
shall, on a quarterly basis, report the weight of each recyclable
material disposed of or collected to the Municipal Recycling Coordinator
so that accurate reports can be filed by the Township with the County
of Monmouth and State of New Jersey.

A summons alleging a violation of this chapter
may be issued by the Municipal Recycling Coordinator, the Monmouth
County Health Department and any other official or employee of the
Township of Freehold by any law enforcement officer or by any civilian,
provided that the summons is issued pursuant to the rules of court.
