[HISTORY: Adopted by the Township Committee of the Township of Medford 4-4-1973 as Ord. No. 1973-6; amended 8-2-1983 by Ord. No. 1983-16. Other amendments noted where applicable.]
No chemical defoliants of any nature or description may be used or stored within the Township limits of the Township of Medford unless the owner or user thereof shall have first obtained written permission from the Environmental and Open Space Advisory Commission of the Township of Medford.
In no event shall permission be given by the Environmental and Open Space Advisory Commission of the Township of Medford to use any chemical defoliant in any wooded areas or within 200 feet of a wooded area or within 200 feet of any lake, marsh or stream.
Application for use other than the prohibited uses set forth in § 57-2 shall be made in writing at least 10 days prior to the regular meeting of the Environmental and Open Space Advisory Commission. The application shall state with particularity the exact area of the Township for the intended use of the defoliant, the type of defoliant to be used, the name and address and telephone number of the person or corporation proposing to use the same, the distance from any wooded area or lake, marsh or stream, the exact time of day said use is proposed and the purpose behind the proposed use, as well as such other reasonable information as may be required by said Commission.
The Environmental and Open Space Advisory Commission shall have the power to deny or modify the proposed use. In the event such use is denied or modified by the Commission, the applicant may appeal to the Township Council within 15 days after said denial or modification.
Any person, firm, partnership or corporation convicted of violating any of the provisions of this chapter shall be liable to a fine of not more than $500 or imprisonment for a term not exceeding 90 days, or both, at the discretion of the Judge.
