The Township of Medford shall permit charitable
organizations as defined in N.J.S.A. 45:17-20 to solicit contributions
from motorists in roadways located in the Township in accordance with
the provisions contained herein.
All charitable organizations as defined in N.J.S.A.
45:17-20 who wish to solicit contributions in roadways in the Township
of Medford shall file an application with the Township Clerk containing
the following information:
A.
Name of applicant organization.
B.
Address of applicant organization.
C.
Telephone number of applicant organization.
D.
Contact person of applicant organization.
E.
Specific location or locations of proposed charitable
solicitations.
F.
Dates and times of proposed solicitations. In no circumstances
may a solicitation exceed the hours of 8:00 a.m. to 7:00 p.m.
G.
The number of individuals, who are at least 18 years
of age, that will be participating in the solicitation.
H.
If the request pertains to a location on any county
highway, or intersection of a county highway, approval must be obtained
from the Burlington County Board of Chosen Freeholders.
I.
If said request pertains to locations on any state
highway or intersection of a state highway, the applicant shall include
a copy of an authorization from the Commissioner of Transportation
of the State of New Jersey to permit the solicitation.
J.
Describe in a complete manner how the motorist solicitation
will be conducted and the procedures to be used to ensure the safety
of the members of the public who will be travelling the roadway.
Upon filing of a complete application in accordance
with the provisions of this chapter, the Township Clerk shall present
to the Township Council for its review and consideration a resolution
in which the Township Council shall grant or deny the applicant's
request. Before an application is presented to the Township Committee,
the Township Clerk must confer with the Chief of Police to determine
if the proposed solicitation location is appropriate. Once application
has been approved by the Township, the Township Clerk must then submit
the application and resolution to the Board of Chosen Freeholders
of Burlington County for approval, if county roads are involved. Freeholder
approval will be issued by either the County Administrator or County
Engineer.
Applicants shall comply with the following provisions
during the solicitation:
A.
In no event shall any charitable organization requesting
authorization from the Township of Medford use any individual under
the age of 18 years to perform any function or task associated with
the charitable solicitation in any roadway.
B.
Any charitable organization requesting authorization
from the Township for charitable solicitations shall comply with the
terms and conditions of N.J.S.A. 39:4-60.
C.
Solicitations shall be permitted only at signalized
intersections or when the existing traffic control device causes temporary
interruption in the flow of traffic. Participants may only approach
vehicles for purposes of solicitation when traffic is at a standstill.
No solicitations are allowed when the traffic signal has turned green
or when traffic is in motion. A participant shall not stop or impede
the flow of traffic to collect solicitations.
D.
All participants must wear orange safety vests when
soliciting for charitable contributions.
E.
The name of the organization shall be clearly displayed
to the travelling public.
F.
Any and all clean-up is the responsibility of the
charitable organization.
G.
Those soliciting contributions shall not drink alcoholic
beverages, use drugs, or be under the influence of drugs or alcohol
when soliciting contributions.
H.
The Township of Medford or the County of Burlington
shall not be liable in any civil action for damages for property damage
or personal injury resulting from a motor vehicle accident arising
out of or in the course of solicitations conducted by a charitable
organization. The charitable organization shall execute an indemnification/hold
harmless letter protecting the Township and the county.
I.
The Township of Medford, and when county roads are
involved, the county, has the right to rescind its approval at any
time if any conditions set forth in this chapter are not being complied
with.
