The provisions hereof relate to the parks, streams,
lakes and recreational areas within the jurisdiction of the Township
of Pittsgrove, in the County of Salem and State of New Jersey, hereinafter
referred to as “park areas,” and to all persons who enter
upon or use said areas. The Township Committee of the Township of
Pittsgrove, in the County of Salem and State of New Jersey is hereinafter
referred to as the “Committee.”
It shall be unlawful for any person in park
areas to:
A.
Willfully mark, deface, disfigure, injure, tamper
with or displace or remove any tree, plant, building, bridge, table,
bench, fireplace, railings, paving, waterlines or other public utilities
or parts or appurtenances thereof, signs, notices or placards, whether
temporary or permanent, monuments or other structures or equipment,
facilities or property or appurtenances whatsoever, either real or
personal, without the authorization of the Committee.
C.
Hunt, molest, harm, frighten, pursue, kill, trap,
chase, tease, shoot or throw any missile at any animal or bird or
to remove or have in his possession the young of any wild animal or
the eggs or nest or young of any animal or bird.
D.
Throw, discharge or otherwise place or cause to be
placed in the waters of any fountain, pond, lake, stream or other
body of water in or adjacent to any part of any tributary, stream,
storm sewer or drain flowing into such water any substance, matter
or thing, liquid, solid or gas which will or may result in the pollution
of said waters, including but not limited to those materials designated
as hazardous waste pursuant to New Jersey Statutes.[2]
E.
Dump, deposit or leave any bottles, broken glass,
ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse
or other trash, and no such refuse or trash shall be placed in any
waters in or contiguous to park areas or left anywhere on the grounds
thereof, but shall be placed in the proper receptacles where these
are provided and, where receptacles are not so provided, all such
rubbish or waste shall be carried away from park areas by the person
responsible for its presence and properly disposed of elsewhere.[3]
G.
Ride a bicycle on other than a paved vehicular road
or path designated for that purpose or to leave a bicycle lying on
the ground or paving or set against trees or in any place or position
where other persons may trip over or be injured by them.
H.
Bring any animal into any park area except horses in compliance with Subsection R of this section, except as permitted for Township-sponsored events.

I.
Indecently expose his person or dress or undress on
any beach or in any vehicle, toilet or other place in park areas.
J.
Swim, bathe or wade in any lake, stream or other body
of water in park areas, except as may be authorized by the Committee.
K.
Launch, dock or operate any boat of any kind or character
in the waters aforesaid except as may be authorized by the Committee.
L.
Use, carry or possess firearms of any description
or air rifles, spring guns, bows and arrows, slings or any other forms
of weapons potentially inimical to wild life and dangerous to human
safety or any instrument that can be loaded with and fire blank cartridges
or any kind of trapping device.
M.
Picnic in a place other than those designated for
that purpose or violate the regulation that the use of individual
fireplaces, together with tables and benches, follows generally the
rule of “first come, first served,” unless reservations
are approved in advance by the Committee for groups and organizations.
N.
Use any portion of the picnic areas or of any of the,
buildings or structures therein for the purpose of holding picnics
to the exclusion of other persons, nor shall any person use such area
and facilities for an unreasonable time if the facilities are crowded.
O.
Leave a picnic area before the fire is completely
extinguished and before all trash in the nature of boxes, paper, cans,
bottles, garbage and other refuse is placed in the disposal receptacles
where provided. If no such trash receptacles are available, then refuse
and trash shall be carried away from the area by the picnicker to
be properly disposed of elsewhere.[5]
P.
Set up tents, shacks or any other temporary shelter
for the purpose of overnight camping, nor shall any person leave in
the park areas after closing hours any movable structure or special
vehicle to be used for such purpose, such as a house trailer, camp
trailer, camp wagon or the like without prior approval of the Committee.
Q.
Take part in or abet the playing of any games involving
thrown or otherwise propelled objects such as balls, stones, arrows,
javelins or model airplanes, except in areas set apart for such forms
of active recreation by the Committee.
R.
Ride a horse, except on designated bridle trails.
Where permitted, horses shall be thoroughly broken and properly restrained,
and ridden with care, and shall not be allowed to graze or go unattended
nor shall they be hitched to any rock, tree or shrub.
S.
Ride and/or operate dirt bikes and/or all-terrain
vehicles (ATVs), unless the vehicle is approved for a specific use
by an individual or organization for an approved event.

T.
Allow animals or pets of any kind in any Pittsgrove
Township facility, unless it is a medically approved service animal
accompanying the owner.

U.
Park in a location that is not in a designated parking
area. Vehicles illegally parked will be subject to towing at the owners'
expense.

V.
Possess firearms, fireworks, bows, arrows, slings
and other projectiles, including golf clubs and golf balls.

W.
Possess and/or use alcohol and/or drugs in any Pittsgrove Township
facility, except as permitted for Township-sponsored events.

A.
Lakes, streams and other bodies of water in park areas
which are suitable for fishing shall be available to the residents
of the Township of Pittsgrove for public fishing at lawful times and
in such lawful manner as may be permitted by the laws of the State
of New Jersey.
B.
The Committee may curtail or strictly prohibit any
or all fishing privileges authorized hereunder which it deems necessary
for the conservation and preservation of fish or any other reasonable
cause in which the best interest of the is in any manner involved.
While in park areas all persons shall conduct
themselves in a proper and orderly manner and, in particular, no person
shall:
B.
Enter into or loiter or remain in any part, structure
or section thereof which may be reserved and designated for the use
of the opposite sex. Exception is made for children under six years
of age.
D.
Build or attempt to build a fire except in such areas
and under such regulations as may be designated by the Committee.
No person shall drop, throw or otherwise scatter lighted matches,
burning cigarettes or cigars, tobacco paper or other inflammable material
within park areas or any highway, road or street abutting or contiguous
thereto.[3]
E.
Enter an area posted as “closed to the public,”
nor shall any person use or abet the use of any area in violation
of posted notices, including but not limited to parking in areas designated
for the handicapped.
G.
Sleep or protractedly lounge on the seats or benches
or engage in loud, boisterous, threatening, abusive, insulting or
indecent language or engage in any disorderly conduct or behavior
tending to a breach of the public peace.[5]
H.
Expose or offer for sale any article or thing, nor
shall any person station or place any stand, cart or vehicle for the
transportation, or sale or display of any such articles or things,
without written consent of the Committee.
I.
Paste, glue, tack or otherwise post any sign, placard,
advertisement or inscription whatever, except as may be authorized
by the Committee.
A.
Except for unusual and unforeseen emergencies, park
areas shall be open to the public every day of the year during daylight
hours, except that Green Branch Park, which has artificial lights
for its facility, shall be permitted to stay open after daylight hours
during authorized use of said lights.

B.
Park areas or any section thereof may be declared
closed to the public by the Committee at any time and for any interval
of time, either temporarily or at regular and stated intervals (daily
or otherwise) and either entirely or merely to certain uses, as the
Committee shall find reasonably necessary.

A.
Pittsgrove Township public parks and recreation facilities
are for the use and benefit of the general public and shall remain
accessible to all members of the public from dawn to dusk, unless
otherwise reserved and approved by the Pittsgrove Township Committee,
or otherwise set forth in this chapter. All such uses shall be in
accordance with the applicable state, county and local laws and ordinances.

B.
Pittsgrove Township Public Works Department shall
exclusively set a schedule to rest and maintain any given field at
any Pittsgrove Township facility.
C.
Pittsgrove Township shall not be responsible for lost
or stolen property or any damage to personal property while on Township
premises.
D.
Pittsgrove Township shall not be responsible for any
costs incurred in enforcing rules, laws or ordinances applicable to
use of the facilities or expenses arising from improper or unapproved
use of the facilities by individuals or organizations.

The following provisions shall apply to any
request to use a park or park facility:
A.
Reservations are required at least 30 calendar days
in advance for most activities, however those events which will likely
utilize the majority of any given complex for four hours or more on
any given day (such as tournaments, community celebrations, etc.)
shall be scheduled at least 60 days in advance in order to provide
ample time to prepare the facility.
B.
Requests for park usage shall be filed, in writing,
in the appropriate format to the Department of Public Works Secretary,
who shall ensure that all required documents are part of the submission.
The Township Administrator shall also be supplied a copy of the application
and shall be responsible to confirm that there are no date conflicts
as to facility use. If the Department of Public Works Secretary and
Township Administrator are in an accord that the application is appropriate
and there are no date conflicts, the application shall be submitted
to the Municipal Clerk and made a part of the next available meeting
agenda for purposes of seeking consideration and approval of the Township
Committee. The Municipal Clerk will inform the Department of Public
Works Secretary of any action taken by the Township Committee on each
application. The Department of Public Works Secretary will correspond
with the applicants to convey any such action taken; will calendar
all approvals; and will provide the Recreation Advisory Committee
with approvals/calendar updates reflecting the use of the parks in
order to better plan recreational events on behalf of the Township.

C.
Conflicts in scheduling are to be reported immediately
to the Pittsgrove Township Recreation Department and must be documented
within 15 calendar days of the scheduled event.
D.
Any complaint regarding the use of any Pittsgrove
Township facility shall be provided, in writing, to the Pittsgrove
Township Administrator within 24 hours of the occurrence.
E.
Individuals or organizations who do not wish to share
equipment with any other individuals or organizations must remove
their equipment immediately at the conclusion of their event or secure
the equipment in their respective storage facilities. Equipment left
in any Pittsgrove Township facility shall be considered available
for public use.

A.
When an applicant requests to reserve all or a portion of a Township
facility, and the intended use of such facility is to accommodate
a significant number of guests and/or participants, the applicant
will be required to exercise due diligence in mitigating any risks
posed to public safety as addressed in this section.
B.
For the purposes of addressing what is and what is not a significant
number of guests/participants, the applicant will report on its facility
use request application the number of expected guests/participants.
These numbers may be based upon historical figures, participant/guest
attendance confirmations, or through another reasonable means.
C.
Whereas it is of the utmost interest of all parties to ensure public
safety, the applicant will be required to hire police officers through
off-duty employment. Police officers may be instructed by the applicant
to ensure that event participators/guests are abiding by the laws
established in this chapter and to safely control traffic at affected
local intersections.
D.
Unless otherwise specifically required by the Township of Pittsgrove, an applicant will be required to fulfill obligations under § 72-5.3C when their expected number of guests/participants meets or exceeds the following:

E.
Unless otherwise specifically required by the Township of Pittsgrove,
an applicant will be required to notify local police, ambulance, and
other emergency response organizations for participants/guests in
excess of 500 individuals and will be subjected to the recommendations
of such organizations.
A.
Law enforcement officers having jurisdiction to enforce
this resolution, in connection with their duties imposed by law, shall
diligently enforce the provisions of this chapter.
B.
The Committee and any park attendant or any person
given lawful authority by the Committee shall have the authority to
eject from the park any person acting in violation of this chapter.
C.
The Committee and any park attendant or any other
person given lawful authority by the Committee shall have the authority
to seize and confiscate any property, thing or device in the park
used in violation of this chapter.
D.
Any person, firm or corporation violating any provisions of this chapter shall be subject, upon conviction, to one or more of the following: imprisonment in the county jail for any term not exceeding 90 days; or by a fine of no less than $100 and not more than $2,000; or by a period of community service not exceeding 90 days, for each offense, pursuant to § 72-4A.
