[Adopted 9-7-1967 as § 13-3 of the Revised General Ordinances; amended in its entirety 1-6-2005 by Ord. No. 05-8]
As used in this article, the following terms shall have the meanings indicated:
CARBON MONOXIDE DETECTOR
An assembly incorporating a sensor, control components, and an alarm notification appliance in one unit, operated from a power supply either located in the unit or obtained at the point of installation, that detects carbon-monoxide gas.
SMOKE DETECTOR
A fire alarm device capable of sensing visible or invisible particles of combustion and providing suitable alarm audible in all sleeping areas.
(As per the New Jersey Uniform Fire Code):
A. 
In Use Groups R-3 and R-4 dwellings subject to the requirements of N.J.A.C. 5:70-2.3, smoke detectors shall be installed as follows:
(1) 
On each level of the premises; and
(2) 
Outside of each separate sleeping area.
B. 
The smoke detectors required above shall be located in accordance with NFPA 74-1984, incorporated herein by reference, and maintained in working order.
(1) 
The detectors shall not be required to be interconnected.
C. 
Smoke detectors may be battery-powered and shall be listed in accordance with ANSI/UL 217, incorporated herein by reference:
(1) 
A/C-powered smoke detectors shall be accepted as meeting the requirements of this section.
D. 
Carbon monoxide alarms shall be installed in all dwelling units in buildings in Use Groups I-1, R-1, R-2, R-3 and R-4, except for units in buildings that do not contain a fuel-burning device or have an attached garage, as follows:
(1) 
Single station carbon monoxide alarms shall be installed and maintained in the immediate vicinity of the sleeping area(s).
(2) 
Carbon monoxide alarms may be battery-operated, hard-wired or of the plug-in type and shall be listed and labeled in accordance with UL-2034 and shall be installed in accordance with the requirements of this section and NFPA-720.
A. 
The owners or managing agents of all residential buildings shall install and maintain smoke detectors in full operating condition in the locations prescribed by the rules and regulations adopted by the State of New Jersey.
B. 
It shall be the duty of the tenant or occupant of a dwelling unit, at his/her own cost and expense, to maintain and replace all batteries of battery-operated smoke-detector devices installed by the owner in such dwelling unit. Any tenant who fails to maintain and replace such batteries shall be guilty of violating this section.
C. 
The duty of the tenant to maintain the battery shall not relieve the owner of the duty to maintain the detector unit in proper operating order other than the battery in the dwelling unit, as well as the duty to maintain both the battery and the unit installed in the common areas of the dwelling.
It shall be unlawful for any tenant, occupant, owner, agent or any other person to tamper with, damage, destroy, steal, paint over or do anything to cause such smoke/carbon monoxide detector or any of its parts to malfunction or fail to operate.
Any residential premises having in operation a form or system of electronic or other fire detection system, device or similar system approved by the Uniform Construction Code as an alternative alarm system shall be exempt from the equipment requirements of this article as to all areas so protected.
Compliance with this section shall be mandatory for premises devoted to single-family residences, including semiattached or rowhouses, on or after June 1, 1980, and for multifamily residences, including apartment houses, and other residential housing, including two or more dwelling units, on or after September 1, 1980; provided, however, that no residential property shall be sold and no building permit shall be issued for any structural alteration or repair except upon certification by the applicant of compliance with the requirements of this article and the regulations promulgated hereunder at any time on or after June 1, 1980. The effective date of this article shall be June 1, 1980, with respect to any residential property which is conveyed or for which a building or plumbing, electrical or other construction or repair permit is issued on or after such date. The Construction Official shall issue notices of this requirement in connection with the issuance of any building permit.
Any person violating the provisions of this section shall, upon conviction, be subject to the penalties set forth in Chapter 1, Article III, General Penalty.
The codification of this article within this chapter shall not be considered to vest exclusive jurisdiction to the Fire Prevention Bureau in the terms of its enforcement, and violations of this section may be enforced by other City officials, including the personnel of the Division of Fire, Division of Inspection (Housing Division), Department of Housing and Economic Development, and the Division of Police.
Before any transfer of ownership takes place on a one- or two-family dwelling in accordance with N.J.A.C. 5:70-2.3(a) a certificate of smoke detector/carbon monoxide detector compliance shall be applied for and the appropriate fees paid before an inspection is conducted. This application is available at the Department of Inspections' Division of Housing and must be returned to that Department. Upon completion of the inspection and the necessary detectors are installed where required, a certificate of inspection shall be issued. It shall be a violation of this code and the Uniform Fire Code of the State of New Jersey to change ownership of a one- or two-family dwelling prior to receipt of the certificate.
