[Adopted 9-7-1967 as § 9-13 of the Revised General Ordinances]
No person shall transport milk, cream or milk products into the City of Trenton for the purpose of sale without having first obtained a permit from the Division of Health.
Application for a permit shall be made upon forms supplied by the Division of Health. The applicant shall indicate the source of supply of the milk and shall supply such other information as the Division may reasonably require.
The fee for a permit under this article shall be $5 per year for each vehicle used in the transportation of milk.
All sales of milk shall conform to the following regulations:
A. 
All milk and cream, whether sweet or sour, sold to a purchaser, at retail, within the corporate limits of the City of Trenton, shall be delivered to such purchaser in bottle form and in the bottle in which it was originally put up, except in approved dispensers, and not otherwise.
B. 
It shall be unlawful for any person to produce, sell, expose or offer for sale, or have in his/her possession, with intent to sell, any milk, without first obtaining a permit from the Division of Health, or milk products, except the following:
(1) 
"Certified," as defined by an act entitled "An act providing for the incorporation of medical milk commissions and the certification of milk products under their supervision and regulating the sale of milk as certified milk," approved April 21, 1909, as amended.
(2) 
"Pasteurized," which has been pasteurized in accordance with the provisions of an act entitled, "An act to regulate the pasteurization of milk, cream or other milk products, to provide for the licensing of establishments where milk, cream and other milk products are pasteurized, and to confer upon the Board of Health of the State of New Jersey, power to make rules and regulations regarding the pasteurization of such milk, cream and other milk products," approved April 13, 1915, as amended, and the rules and regulations promulgated by the State Board of Health in pursuance thereof.
Violations of the provisions of this article shall be punishable as provided in Chapter 1, Article III, General Penalty.
