[Adopted 6-17-1932 as Sections 2, 3, 13, 26 and 28 of the

No person shall deposit material used for building
or other purposes upon any highway of the Village or dig or cause
to be dug any excavation or other opening in the highways therein
for any purpose, except with the permission and under the direction
of the Village officer or officers having charge of the public work
incidental to which such excavation is required.
No person shall in any way mutilate, cut down,
injure or destroy any shade or ornamental tree or shrub upon the streets,
sidewalks or parks within the Village without a permit from the Village.
No person shall engage in any parade upon the
streets, sidewalks or public places of the Village without a permit
from the Village.
No person or persons shall throw, drop or project
any heavy object upon the sidewalks or pavements of the Village so
as to injure the same.
If any fence, building or other permanent structure
shall at any time encroach upon the boundaries of any street in the
Village, the owner or owners thereof or the occupant or occupants
of the lot which shall adjoin the same shall remove the same within
10 days after notice in writing to do so shall be served upon them
by the Village of Brewster Board of Trustees.
Any person committing an offense against any
of the provisions of this article shall be guilty of a violation and,
upon conviction thereof, shall be punishable for each offense by a
penalty of not more than $250 or by imprisonment for not more than
15 days, or both.
This article shall be enforceable by the Village
of Brewster Highway Superintendent and Code Enforcement Officer, and/or
Village police, who are hereby authorized to issue and serve an appearance
ticket with respect to violation(s) of this article.

Editor's Note: Section 1 of this local law,
which did not specifically amend the Code, contained the following
definition: "SIDEWALK — That portion of a street between
the curblines and the adjacent property lines intended for use by
pedestrians and commonly limited to nonvehicles, as the term 'vehicle'
is defined by § 159 of the New York State Vehicle and Traffic
Law."
A.
The owners and occupants of properties adjoining sidewalks
commonly used by the public in the Village of Brewster shall keep
such sidewalks in repair and free and completely clear of snow, ice,
dirt and other obstructions. With respect to the clearing of snow
and ice removal, such must be removed within 24 hours after the period
in which such snow or ice has accumulated. All other repairs and maintenance
shall be performed within a reasonable time period.
B.
For the purposes of this article, "obstructions" shall
be deemed to include but not be limited to boxes, crates, carts, bags,
cartons and packages.
A.
In default of such repair or removal of obstructions
as required, the Village may effect such repair or removal at the
expense of such owners or occupants, and the charges therefor shall
be a lien upon the premises until paid.
This article shall be enforceable by the Village
of Brewster Highway Superintendent and Code Enforcement Officer, and/or
Village police, who are hereby authorized to issue and serve an appearance
ticket with respect to violation(s) of this article.
This article shall replace and completely render
null and void Local Law Number 2 of 2001.
