The provision of §§ 20, 23 and 31 of the Town Law, § 109 of the Uniform Justice Court Act and § 3 of the Public Officers Law and any other provisional law requiring a person to be a resident of a political subdivision or a municipal corporation of the state for within which he or she shall be chosen or within which his or her official functions are required to be exercised are waived to the extent that such provision shall not prevent a person from holding the office of Clerk to Justice, provided that said person is a resident of the County of Dutchess and so long as all other qualifications contained in §§ 20, 23 and 31 of the Town Law, § 109 of the Uniform Justice Court Act and § 3 of the Public Officers Law are satisfied by the appointee of such office. This amendment is pursuant to Municipal Home Rule Law § 10, Subdivision 1, Paragraphs (ii)d(3), (ii)a(12) and (ii)a(14), and does supersede the provisions of §§ 20, 23 and 31 of the Town Law, § 109 of the Uniform Justice Court Act and § 3 of the Public Officers Law and any other law inconsistent with the provisions hereof.
The Clerk to Justice shall be compensated by a fixed salary.
