A.
Any person who violates or causes to be violated any
provision of this chapter or of the terms or conditions of any approval
of any subdivision approved by the Planning Board under this chapter
shall be guilty of an offense and be punishable as follows:
(1)
For a first offense, by a fine not exceeding $350
or imprisonment for a period not to exceed 15 days, or both.
(2)
For a second offense, both of which were committed
within a period of five years, by a fine not less than $350 nor more
than $700 or imprisonment for a period not to exceed 15 days, or both.
(3)
For a third or subsequent offense, all of which occurred
within a period of five years, by a fine not less than $700 nor more
than $1,000 or imprisonment for a period not to exceed 15 days, or
both.
B.
Each day's continued violation shall constitute a
separate additional violation.
