A.
This article is intended to provide guidance and to assist
prospective developers in the Township of Pine which desire connection to,
extension to or construction of a separate sanitary collecting sewer system.
The details of construction of those facilities which are proposed to be designed
and constructed within streets and other public rights-of-way and, upon proper
completion, will be conveyed to the Township for operation and maintenance
are set forth in the current Specifications for the Construction of Sanitary
Sewer Pipe Lines and Appurtenances, copies of which are available for inspection
and review in the Pine Township Municipal Building during normal business
hours. This, then, addresses notifications, payment of fees, certain engineering
requirements, scheduling of construction work, surety requirements, inspections
and other administrative procedures necessary to obtain the Township's approval
as the work commences, progresses and is completed.
B.
The Specifications for the Construction of Sanitary Sewer
Pipe Lines and Appurtenances, which detail construction requirements for sewer
service laterals which are proposed to connect dwellings, commercial establishments
and/or institutional and industrial buildings, and which are located on private
property are on file in the Township offices.
As the first step toward obtaining the Township's approval of extending
or constructing sewer service to any location within the Township's service
area, the developer or his representative must file a letter requesting the
same in which a general description of the proposed improvements is included,
along with a photocopy of a map on which the property to be developed is superimposed.
Such information need not be technical nor detailed but should be sufficiently
clear to illustrate what is proposed to be constructed and where.
The Township will respond to the developer's preliminary letter for
the purpose of establishing a date and a time mutually agreeable for a preapplication
conference, to be held in the Township's office. The purpose of the conference
will be for the developer to elaborate upon the proposed project and for the
Township's representatives to elaborate upon its requirements relative to
the sewer work expected to be performed. The developer shall have its engineer
in attendance at the conference so that the Township's representatives may
communicate directly with him concerning the Township's requirements relative
to preparation of plans, performance of surveys, submittals, obtaining approvals
and otherwise performing the developer's engineering work in compliance with
the Township's rules and regulations.
A.
The Township may approve the design and construction
of wastewater treatment plants, pump stations or force mains by the developer,
or the Township will design and construct wastewater treatment plants, pumping
stations and force mains. The allocated cost of the same to the developer
will be disclosed by the Township to the developer after receipt of construction
bids and prior to commencement of construction. In general, if such facilities
serve only the respective proposed development, the developer will be responsible
for the total costs of construction, engineering and inspection incurred by
the Township; if, on the other hand, such facilities are determined by the
Township to benefit the Township and/or others, the Township will allocate
such costs and benefits and will negotiate an agreement with the developer
before approval of the plans for the project.
B.
All plans, profiles and details shall be prepared on
tracing film 24 inches by 36 inches in size.
C.
All pipeline plans shall be prepared at a scale of one
inch equals 50 feet; all profiles shall be prepared at a scale of one inch
equals 50 feet (horizontal) and one inch equals 10 feet (vertical). Scale
of any required details shall be agreed upon prior to commencement of design.
General location maps/plans shall be prepared on a scale of one inch equals
400 feet.
D.
All plans shall show property lines, rights-of-way, lot
layouts, creeks, streams, existing buildings, existing utility lines and other
topographic features.
E.
A brief narrative report shall be prepared identifying
sewage loadings and all characteristics of flows which are nondomestic and
providing all technical information required for any industrial, commercial
or institutional user and for the ultimate attainment of approval of any relevant
regulatory agencies. A wastewater contribution permit, the requirements relative
to which are described within the Rules and Regulations Governing Use of the
Sewer System, must be applied for and obtained by all system users anticipating
the contribution of any nondomestic wastewater.
F.
Following the date of receipt of all properly prepared
plans, profiles, details, the narrative report and other filings, the Township
will review, comment upon, approve, reject or return said submittals within
21 calendar days.
G.
All designs of sewer lines and appurtenances shall conform
to the appertaining requirements of the Pennsylvania Department of Environmental
Resources. All proposed work which will involve construction activity or other
encroachment upon Township streets or roads or highways under the jurisdiction
of the state shall be subject to the prevailing rules and regulations of those
agencies (Pine Township and the Department of Transportation, respectively).
H.
Submission of detailed plans shall be accompanied by
all right-of-way descriptions pertaining to facilities proposed to be ultimately
conveyed to the Township for operation and maintenance.
A.
After approval of the plans by the Township, a formal
application to construct shall be filed with the Township on forms which will
be furnished by it. An agreement between the Township and the developer shall
then be negotiated, commensurate with the signing of which the developer shall
pay a filing fee.
B.
The amount of the filing fee shall be determined as indicated in Ch. A144, Fees, made payable to the Township. Proceeds from such fees will be utilized by the Township for deferring the costs of administration, engineering and inspection. Any residual of the original fee shall be refunded to the developer.

Highway occupancy permits, (Department of Transportation)
and Water quality management and other permits (Department of Environmental
Resources), promulgated for construction of sewer lines, shall be applied
for and obtained by the developer from those agencies. No construction work
in the field may commence until such permits have been formally approved and
are in the possession of the Township.
No materials may be utilized for construction of any sewer facilities
which have not been submitted to the Township by the developer and approved
by the Township, in accordance with the paragraph addressing that subject
which is included in the Specifications for the Construction of Sanitary Sewer
Pipe Lines and Appurtenances.[1]

No construction shall commence until a proposed schedule of the work
is filed; all required permits have been obtained; the agreement with the
Township has been formalized and executed by both the Township and the developer;
the filing fee has been paid in full; performance, payment and eighteen-month
maintenance bonds (on forms satisfactory to the Township) have been posted
and approved by the Township and; at least one week's advance notice of commencement
has been filed with the Township.
Unless otherwise approved by authorized Township personnel, no developer
and/or contractor shall conduct construction activities on the site of the
work before 7:00 a.m., after 5:00 p.m. or on Saturdays, Sundays or holidays
observed by Township personnel.
All communications with the Township shall transpire with its Manager
or his designee. The developer shall identify, in writing, the person with
whom the Township should communicate. The person representing the developer
may be a contractor's employee, an engineer or other person but, in any event,
shall have the authority and the ability to respond to and reconcile application
problems or other job-related problems.
