No person engaged in any hauling, building, construction, grading, excavation, road cutting, land development or subdividing within the Township or engaged in the laying of any water- or sewer lines or other utility installations or engaged in the transportation of soil, stones, building materials or debris within the Township, shall cause or allow the tracking or disposition of mud, soil, stones, building materials, debris or any material of any kind on any road with the Township. Any material of any kind whatsoever tracked, placed, dropped or deposited on any road shall be completely removed from said road immediately, but in no case later than 5:00 p.m. of the day on which such tracking, placement or disposition occurs.
Wheel and truck cleaners shall be required on site at any transport origin and destination point within the Township, and vehicles shall be scraped and cleaned before leaving the site.
All persons shall take reasonable measures, including but not limited to wetting down or other treatment of materials, before leaving the site to ensure that during transit no material being transported shall blow or spill over upon any road or private property.
The Township shall not issue any grading permit until the person applying for such permit has furnished a bond with suitable requirements, conditioned on compliance by the person with the provisions of this article, with sufficient surety, or other security approved by the Township Solicitor, in the amount of a minimum of 5% of the estimated cost of the work contemplated.
The Township shall not issue any road opening and excavation permit until the person applying for such permit has furnished a bond with suitable requirements conditioned on the compliance by the person with the provisions of this article, with sufficient surety or other security approved by the Township Solicitor, in the amount of a minimum of 25% of the amount of the estimated cost of the work.
One of the conditions of the bonds or other security specified in §§ 72-13 and 72-14 of this article shall be that, in the event that the person does not comply with the provisions of this article or any special conditions imposed by the Board of Supervisors, the Township may elect to cure any deficiencies at the expense of such person, in which event the proceeds of the bonds or other security shall be due and payable to the Township. If the proceeds of the bonds or other security shall be insufficient to cover the Township's expenses of curing such deficiencies, the persons shall forthwith pay to the Township the amount of the difference. Any excess in the proceeds in the bonds over the amount of the expenses of the Township to cure any such deficiencies shall be refunded to the person.
The Township police shall be responsible for the enforcement of this article and shall report any violations of this article to the Board of Supervisors in their monthly report after appropriate enforcement measures have been taken.
The Township Manager shall notify the Township police of the posting of bend or other security under the terms of this article and the conditions thereof.
Whenever the Township police have notified the Township Manager and Zoning Officer that a person has violated the provisions of this article, any Township permit which the person holds shall be automatically revoked. However, the Township police may, for minor violations, give any person 24 hours' notice to remedy the violation.
A. 
Any person violating any of the provisions of this article shall be liable, upon conviction thereof before a District Justice or other proper judicial officer, to a penalty not exceeding $300, plus costs of prosecution, for each and every offense. This penalty shall be in addition to any other remedies available to the Township.
B. 
Whenever any person has been notified by the Township police by issuance of a citation, service of summons in a prosecution or in any other way in writing that he is committing a violation of this article or that he is engaged in activity requiring the posting of bond under this article or that any day of his Township permits have been revoked, each and every day that he shall continue such violation after such notification shall constitute a separate offense punishable by a separate penalty.
