From and after the effective date of this article and pursuant
to the above-mentioned Order of Court at Case No. 5682 of 2005,[1] the Township hereby formally substitutes the 7.7 acres
of Township property as shown on the GIS Map of Allegheny County and
known as "the Beyerle property" and located at the intersection of
Beyerle Road and Little Pine Creek Road in Shaler Township, which
property is of at least equal size and value, in exchange for the
Kiwanis Park trust property, pursuant to 53 P.S. ยงย 3384(1),
and the Township of Shaler hereby formally dedicates forever said
Beyerle property for recreational purposes.

Editor's Note: By Order of Court dated October 24, 2005,
the Township, at Case No. 5682 of 2005, in the Orphans' Court
of Allegheny County, was ordered to formally substitute by ordinance
the 7.7 acres of Township property known as "the Beyerle property"
and located at the intersection of Beyerle Road and Little Pine Creek
Road in Shaler Township, which property is of at least equal size
and value, in exchange for the Kiwanis Park trust property of approximately
0.96 acres, pursuant to 53 P.S. ยงย 3384(1), subject to the
reversion conditions set forth in the Declaration of Relinquishment
of the Kiwanis Club of Glenshaw at Deed Book Volume 12548, Page 495.
