It is hereby made unlawful for any owner, custodian or keeper to allow or permit any dog to run at large upon the highways, roads, public or private property of persons other than the owner within the Township of Shaler.
Any dog found upon the Township highways, roads or on public or private property in violation hereof may be seized or detained by any police officer of the Township and notice given to said owner, custodian or keeper. A copy of the notice shall also be sent to the Code Enforcement Officer. Any dog so sighted and kept within the care of the Township may be released to the owner upon payment of costs of seizure or detention, provided that the owner, custodian or keeper claims the dog within seven days after notice, or it may be turned over to the appropriate authorities for safekeeping or disposal.
If said owner, custodian or keeper of said dog, having been notified as per the provisions of this article, shall further allow the dog to be on said highways, roads or public or private property in violation of § 80-1 of this article, said owner, custodian or keeper so offending shall, upon conviction thereof by any issuing authority, be sentenced to pay a fine of not more than $600 and may be sentenced to a period of incarceration not exceeding 90 days in the Allegheny County Jail, at the discretion of the issuing authority; if the dog is not seized, the owner, custodian or keeper shall be notified that the dog is at large in violation of § 80-1 hereof. Each incident in violation of this article shall be considered as a separate offense and shall be punishable as such.
For the purpose of this article, written notice left with any adult at the residence shall be good and valid notice.
