As used in this article, the following terms shall have the meanings indicated:
AUTHORITY
The Hampton-Shaler Water Authority or such other authority by whom water is supplied to premises in Shaler Township.
COSTS
Includes, but is not limited to, the costs of all materials (pipes, valves, fittings, fire hydrants, etc.) and the labor of any authority personnel in connecting a waterline extension to the main authority waterline and in supervision and inspection, rights-of-way and legal and engineering fees.
CUSTOMER
The owner of the premises to which water is furnished by an authority or is to be furnished by a waterline extension.
NEGLIGENCE
The failure to exercise the care that a reasonably prudent person would exercise in like circumstances. For purposes of this section, negligent conduct shall also include intentional or reckless conduct.
All waterline extensions shall comply fully with the rules and regulations of that authority which supplies water to the premises, and it shall be unlawful for any person to extend any waterline in violation of such rules and regulations.
All waterline extensions in Township highways, streets, alleys and/or lanes shall be graded to the satisfaction of the Township of Shaler.
Any person, individual, partnership, association or corporation who shall violate § 218-2 of this article, upon summary conviction before a Magisterial District Judge, shall be sentenced to pay a fine or penalty of not more than $600 and may be subject to imprisonment for a term not exceeding 90 days for each offense. The continuance of any violation of § 218-2 for each period of 24 hours after notice of the same by the Township shall be deemed a separate and distinct offense for each twenty-four-hour period. Nothing contained herein shall be deemed to preclude the Township of Shaler or the authority supplying water to such customer to seek other relief or avail itself of any remedy that may be at law or in equity to prevent continuing violation of the terms of this chapter or to restrain or abate such violation.
