This chapter is adopted under the authority
granted by §§ 61.34(1) and 92.11, Wis. Stats.
This chapter shall be known as, referred to,
or cited as the "Environmental Protection Ordinance, Village of Johnson
Creek, Jefferson County, Wisconsin."
This chapter will ensure proper and appropriate
development and construction standards that provide adequate environmental
protection in the Village of Johnson Creek and promote public health,
safety, convenience, general welfare and tax base.
This chapter is intended to promote and regulate
appropriate development and construction practices to:
A. Protect life, health and property;
B. Minimize expenditures of public funds for remediation
efforts;
C. Minimize business interruptions and other economic
disruptions;
D. Minimize damage to public and private facilities;
E. Discourage the victimization of unwary land and home
buyers;
F. Prevent and control erosion, sedimentation and other
pollution of surface and subsurface waters;
G. Preserve natural vegetation and cover and promote
the natural beauty of the Village of Johnson Creek and its environs;
H. Provide for the administration and enforcement of
this chapter;
I. Provide penalties for its violation; and
J. Implement those municipal, county, state, or watershed
or regional comprehensive plans or plan components adopted by the
Village of Johnson Creek and, in general, facilitate enforcement of
Village of Johnson Creek development standards as set forth in the
adopted regional, county and local comprehensive plans, adopted plan
components, Village of Johnson Creek Zoning Ordinance, Village of
Johnson Creek Building Code, and other applicable ordinances of the
Village of Johnson Creek, State of Wisconsin statutes and administrative
regulations and U.S. Environmental Protection Agency regulations.
This chapter shall regulate all areas and zoning
districts in the Village of Johnson Creek.
It is not intended by this chapter to repeal,
abrogate, annul, impair, or interfere with any existing easements,
covenants, deed restrictions, agreements, rules, regulations or permits
previously adopted or issued pursuant to law. However, where this
chapter imposes greater restrictions, the provisions of this chapter
shall govern.
In their interpretation and application, the
provisions of this chapter shall be held to be minimum requirements
and shall be liberally construed in favor of the Village of Johnson
Creek and shall not be deemed a limitation or repeal of any other
power granted by the Wisconsin Statutes.
The Village of Johnson Creek does not guarantee,
warrant, or represent that only those standards and regulations described
and required by this chapter are a full and exhaustive enumeration
of environmental protections required by other applicable regulatory
agencies (e.g., the State of Wisconsin, U.S. Army Corps of Engineers
or U.S. Environmental Protection Agency) and thereby asserts that
there is no liability on the part of the Village Board, its agencies
or employees for failure to meet environmental standards that may
occur as a result of reliance upon and conformance with this chapter.
If the provisions of this chapter conflict with
or contravene any other general or zoning ordinances, the more restrictive
and stringent provisions shall govern.
