There shall be a Department of Engineering within the Township, the head of which shall be the Township Engineer. The Township Engineer shall be appointed by the Township Committee for a maximum term of three years from the first day of January in the year in which he is appointed. The Engineer shall be a duly licensed engineer of the State of New Jersey and shall receive such compensation as may be provided by the Township Committee.

The Township Engineer shall perform such duties as are prescribed by general law and ordinance and in addition shall:
a. 
Prepare or cause to be prepared plans, designs and specifications for public works and improvements undertaken by the Township.
b. 
Provide and maintain surveys, maps, plans, specifications, estimates and control records with respect to public works and facilities owned or operated by the Township or to be acquired or built.
c. 
Provide technical and engineering advice, estimates and review of plans and assistance to other Township departments as needed.
d. 
Attend meetings of the Township Committee, Planning Board and Zoning Board as needed.
e. 
Oversees and directs the zoning enforcement function, including supervision of the Zoning Enforcement Officer.
f. 
All papers, documents, memoranda, reports and other materials relating to the administration of engineering duties of the Township Engineer shall be and remain the property of the Township. Upon the termination of his services with the Township, the Township Engineer shall forthwith surrender to any successor all such property.

Within the Department of Engineering there shall be a Division of Construction Code Enforcement, the head of which shall be the Construction Official or designated subcode official. The Construction Official shall be appointed by the Township Committee for a term as provided by law and shall hold office until his successor shall be appointed and qualified. The Construction Official must possess requisite state licenses. He shall receive compensation for his services as the Township Committee may by ordinance determine.

a. 
There shall be a Fire Official, appointed by the Township Committee with consideration of the recommendation by the Township Administrator and Director of Human Resources. During the recruitment process for the position of Fire Official, the Township Director of Human Resources shall forward resumes to the Chiefs of the Basking Ridge Fire Company No. 1 and Liberty Corner Fire Company for review. At their discretion, Board members can participate in the interview and selection process.
b. 
The Fire Official shall report directly to the Township Engineer.
c. 
The Fire Official shall supervise the Bernards Township Fire Prevention Bureau. The incumbent is responsible for the development and implementation of operating processes and procedures, as well as for the general supervision of all Fire Prevention Bureau employees.
d. 
In addition to other duties assigned by management, the Fire Official shall:
1. 
Enforce the provisions of the New Jersey Uniform Fire Code and applicable Township ordinances.
2. 
Maintain and implement appropriate policies and procedures for the day-to-day operation of the Bernards Township Fire Prevention Bureau.

The Construction Official shall enforce the provisions of Chapter XII of this revision and all other regulations enforced by the Construction Official and shall perform all other duties prescribed by the Township Committee by ordinance or resolution. The Construction Official shall have the following powers and duties:
a. 
He shall have the authority, upon presentation of credentials, to enter any building or premises by himself or with his authorized representative for the purpose of inspection or to prevent violation of Chapter XII.
b. 
He shall keep a record of all proceedings of his office and a book of all complaints made to him as Construction Official, which books shall always be open for inspection by the Township Committee and which shall be the property of the Township.
c. 
He shall report in writing each month all permits and certificates of occupancy issued by him with the estimated cost of the work for which such permits were issued during the next previous month, together with a statement of all fees received by him.

In the event that the Construction Official is directly or indirectly interested in any building or structure for which a permit is required to be issued, the Deputy Construction Official shall issue the permit, inspect the building or structure, and perform the duties of the Construction Official in reference thereto. All fees for such permits shall be collected by the Deputy Construction Official and turned over to the Township Treasurer.

There shall be a Deputy Construction Official appointed by the Township Committee for a term as provided by law.

The Township shall provide subcode officials required by law.
