This article is ordained and enacted pursuant to the requirements and the provisions of law relating to police pension funds, Act 600, Section 4(d), Act of May 29, 1956, P.L. (1955) 1804, as amended [53 P.S. § 770(d), as amended].
The Mifflin County Regional Police Department Consolidated Police Pension Plan, dated August 30, 2001, as prepared by special labor counsel for the Board of Directors of the Mifflin County Regional Police Department, which consolidated pension plan is incorporated herein by reference as if fully set forth, is hereby adopted in accord with the provisions of Section 4(d) of Act 600, as amended [53 P.S. § 770(d), as amended], and in accord with and in reliance on that written opinion of special labor counsel dated December 4, 2001, that said Mifflin County Regional Police Department Consolidated Police Pension Plan, dated August 30, 2001, is in compliance with Act 600, as amended, and with the January 10, 1994, interest arbitration award in relation to the arbitration between the Lewistown Police Association and the Board of Directors of the Mifflin County Regional Police Department.
The Supervisors of the Township of Derry, together with the Township Secretary, are hereby authorized and directed to take all appropriate actions and to execute the Mifflin County Regional Police Department Consolidated Police Pension Plan, dated August 30, 2001, and any other necessary and appropriate documents in accord therewith to effectuate the intent of this article, and all prior actions of said persons in accord with the intent of this article are hereby ratified and confirmed.

Derry Township (the Township), being a member municipality of the Pennsylvania Municipal Retirement System (the system), hereby elects to amend its municipal pension plan administered by the system in accordance with Article IV of the Pennsylvania Municipal Retirement Law, 53 P.S. § 881.101 et seq. (Retirement Law),[1] and does hereby agree to be bound by all the requirements and provisions of the Retirement Law and the Municipal Pension Plan Funding Standard and Recovery Act, 53 P.S. § 895.101 et seq., and to assume all obligations, financial and otherwise, placed upon member municipalities.

As part of this article, the Township agrees that the system shall administer and provide the benefits set forth in the amended Municipal Pension Plan Contract entered into between the Pennsylvania Municipal Retirement Board and the Township effective June 1, 2013 (the contract).
The passage and adoption of this article by the Township is an official acceptance of the contract and the financial obligations resulting from the administration of the contract.
Payment for any obligation established by the adoption of this article and the contract shall be made by the Township in accordance with the Retirement Law and the Municipal Pension Plan Funding Standard and Recovery Act.[1] The Township hereby assumes all liability for any unfundedness created due to the benefit structure set forth in the contract.

The Township intends this article to be the complete authorization of the contract and it shall become effective and specifically repeal Ordinance Number 1995-3 either five days after adoption or on June 1, 2013, which is the effective date of the contract, whichever is later.
A duly certified copy of this article and an executed contract shall be filed with the system.
