STATUTORY AUTHORITY

There is hereby established a Municipal Court to be known as the "Municipal Court of the Township of Cedar Grove, in the County of Essex."
The Municipal Court of the Township shall have an Official Seal which shall be similar to the Official Seal of the Township except as to the name. In place of the name and legend upon the said Township Seal, the Official Seal of the Municipal Court shall bear the impress of the name of the Court.

The Municipal Court of the Township shall have a Judge who shall be known as the Municipal Judge. He shall have the qualifications required by law.

The Municipal Judge of the Township shall be appointed by the Township Council. He shall serve for a term of three years from the date of his appointment and until his successor is appointed and qualified.

The Municipal Judge shall be compensated by an annual salary as more particularly set forth in the yearly Salary Ordinance adopted by the Township Council.[1] The compensation so paid shall be in lieu of any and all other fees.

The Municipal Court of the Township and the Municipal Judge shall have, possess and exercise all the jurisdiction, powers, functions and duties which are or may be conferred by law and the applicable rules of the Supreme Court of New Jersey.

There shall be a Clerk of the Municipal Court of the Township who shall be appointed by the Township Council. He shall serve for a term of one year from the date of his appointment and until his successor is appointed and qualified.

The Court Clerk shall attend all sessions of the Municipal Court of the Township; keep the Official Seal and records of said Court; collect, receipt for and account to the Municipal Judge for all fines, costs, impositions and bail which may be paid into or deposited with said Court; assist the Municipal Judge in the business administration of said Court; and perform such other functions and duties as shall be prescribed for him by law, by the rules of the Supreme Court of New Jersey and by the Municipal Judge.

The Council may designate any officer or employee of the municipality to serve as Deputy Clerk of the Municipal Court with or without additional compensation. Such additional compensation, if any, shall be fixed in the yearly Salary Ordinance adopted by the Township Council. The Deputy Clerk shall assist the Municipal Court Clerk in the performance of his duties.

The Municipal Judge of the Township and the Clerk of the Municipal Court, before entering upon the duties of their offices, shall enter into a bond as required by law.

Pursuant to the current New Jersey Court Rules, if the Judge of the Municipal Court determines that the efficient disposition of its business and the convenience of defendants so requires, he may designate either the Clerk of the Court or a Deputy Clerk of the Court to be Violations Clerk. Such person shall serve as Violations Clerk during the term of the Judge who appointed said Violations Clerk.
