Pursuant to Section 11 of the Uniform Fire Safety
Act (P.L. 1983, c. 383)[1], the New Jersey Uniform Fire Code shall be locally enforced
in the Borough of Palisades Park.

The local enforcing agency shall be the Bureau
of Fire Prevention which is hereby created in the Borough of Palisades
Park.

The Bureau of Fire Prevention shall enforce
the Uniform Fire Safety Act and the codes and regulations adopted
under it in all buildings, structures and premises within the established
municipal boundaries of the Borough of Palisades Park other than owner-occupied
one- and two-family dwellings used exclusively for dwelling purposes
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.

The Bureau of Fire Prevention established by § 143-25 of this article shall carry out the periodic inspections of high-rise structures and life hazard uses on behalf of the Commissioner of Community Affairs and may inspect buildings and premises other than high-rise structures and life hazard uses in order to secure compliance with the State Uniform Fire Safety Act.

The local enforcing agency established by § 143-25 of this article shall be the Palisades Park Bureau of Fire Prevention and shall be under the direct supervision and control of the Mayor and Council of the Borough of Palisades Park.

A.
Appointment of Fire Official. The local enforcing agency shall be
under the direct supervision of the Fire Official, who shall be a
member of the Palisades Park Fire Department, appointed by the Mayor
and Council of the Borough of Palisades Park after recommendation
of the Chief of the Palisades Park Fire Department.
B.
Chief Fire Inspector.

There is hereby created the position of full-time Chief Fire Inspector.
(3)
The Chief Fire Inspector shall be a resident of Palisades Park and
a member of the Palisades Park Fire Department and shall be appointed
by the Mayor and Council after recommendation of the Chief of the
Palisades Park Fire Department.
(4)
Term of office. The Chief Fire Inspector shall serve for a term of
five years. Any vacancy for the unexpired term shall be filled by
the Mayor and Council after recommendation of the Chief of the Palisades
Park Fire Department.
(6)
Duties.
(a)
Under the direction of the Fire Official, the Chief Fire Inspector's
duties shall include enforcement of the Uniform Fire Safety Act[3] and all codes and regulations adopted under it in all
buildings, structures and premises within the Borough, other than
owner-occupied one- and two-family dwellings, and compliance with
the requirements of the Uniform Fire Safety Act and the Uniform Fire
Code.

(b)
During the normal course of the work schedule established for
this position, the Chief Fire Inspector shall be the first responder
to all fire calls and alarms and shall immediately determine the necessity
for response from the Fire Department.
(c)
The Chief Fire Inspector shall conduct all fire inspections
required by the Uniform Safety Act and/or the Department of Consumer
Affairs to ensure compliance with the Code.
(d)
Under the direction of the Fire Official, the Chief Fire Inspector
shall be charged with the issuance of notices and orders to abate
and shall serve them to the public.
(e)
The Chief Fire Inspector shall have suitable identification
and shall establish an office within the office of the Fire Chief.
(7)
Hours; time in office. The Chief Fire Inspector shall be considered
a full-time employee and shall be present in his office for at least
two hours a day between the hours of 9:00 a.m. and 4:00 p.m. and shall
inspect and perform all necessary functions outside of the office
for the balance of the day as may be required by the position and
its duties. The Chief Fire Inspector shall set his hours so that they
can be as uniform as possible.

The Chief Fire Inspector shall be the sole inspector performing the
duties of the Uniform Fire Safety Act and the Uniform Fire Code under
the direction of the Fire Official.
(9)
All prior fire inspectors' terms of office and part-time employees are hereby terminated. In accordance with § 143-29D, should a need arise for additional part-time inspectors, such inspectors may be hired on a per diem basis for inspections which they make. Such per diem inspectors shall be hired by the Mayor and Council upon the advice and consent of the Fire Official.

C.
Term of office. The Fire Official shall serve for a term of five
years. Any vacancy for the unexpired term shall be filled by the Mayor
and Council after recommendation of the Chief of the Palisades Park
Fire Department.
D.
Inspectors and employees. Such inspectors and other employees as
may be necessary in the Bureau of Fire Prevention shall be appointed
by the Mayor and Council of the Borough of Palisades Park, provided
that they meet the following criteria:
(1)
Appointment of the inspector/employee has been recommended by the
Fire Official.
(2)
Candidates for appointment as inspectors shall be members of the
Palisades Park Fire Department and have successfully completed the
Fire Fighting One course and fire inspector's school.
(3)
Candidates for appointment as inspectors have met all state requirements.
(4)
Sufficient funds have been appropriated in the municipal budget.
E.
Removal of inspectors and other employees from office. Inspectors
and other employees of the Bureau of Fire Prevention shall be subject
to removal from office by the Fire Official for inefficiency or misconduct.
Each inspector or employee to be so removed shall be afforded an opportunity
to be heard by the appointing authorities or a designated hearing
officer.
F.
Removal of Fire Official or Chief Fire Inspector from office. The
Fire Official/Chief Fire Inspector of the Bureau of Fire Prevention
shall be subject to removal from office by the Mayor and Council of
the Borough of Palisades Park for inefficiency or misconduct. The
Fire Official or Chief Fire Inspector to be so removed shall be afforded
an opportunity to be heard by the appointing authorities or a designated
hearing officer.

Pursuant to the Uniform Fire Safety Act,[1] any person aggrieved by any order of the local enforcement
agency (or agencies) shall have the right to appeal to the Construction
Board of Appeals of Bergen County.

The use of charcoal burners, portable gas stoves,
propane barbecue stoves and other similar fuel-burning appliances
and the use of portable kerosene stoves or other similar fuel-burning
appliances using highly flammable liquids or gases is prohibited in
or on any multiple dwelling (more than two dwelling units).

The use of charcoal burners, portable gas stoves,

feet of any structure.
