The code and all amendments and supplements hereto shall be known as the "Sanitary Code of the Board of Health of the Borough of Palisades Park," or as the "Sanitary Code."
As used in this chapter, the following terms shall have the meanings indicated:
AIR POLLUTION
The presence in the outdoor atmosphere of one or more added substances in such quantities and of such duration as to be injurious to human, animal or plant life or property or unreasonably interfere with the comfortable enjoyment of life and property.
ANIMAL
For the purpose of this chapter shall mean cat or dog.

BIRDS
Waterfowl, songbirds, pigeons but not limited to blue jays and other birds.

BOARD
The Board of Health of the Borough of Palisades Park.
BOARDINGHOUSE
A private housing or dwelling unit where the owner, tenant or occupant thereof is engaged in keeping two or more boarders not related to him by blood or marriage and in serving food to some or all of such lodgers, for a part of a day or longer period, under expressed contract or rate of payment.
CELLAR
The lowest story of any building, dwelling or tenement house, of which 1/3 or more of the height from the floor to the ceiling is below ground level.
CERTIFIED ANIMAL CONTROL OFFICER
A person who has satisfactorily completed a course of study on the control of animals approved by the Commissioner of Health and Senior Services.

DAY NURSERY (SCHOOL)
A child-care center established for children of preschool age for both morning and afternoon sessions, usually with hot lunches included and with cots for rest provided.
DENSE SMOKE
Smoke which is so heavy and thick as to prevent the seeing of objects through it at the point of emission into the external air or the equivalent of No. 3 grade of the Ringelmann Smoke Chart, the standard device used by the United States Bureau of Mines.
DIRT
Natural soil, earth and stone.
DWELLING
Any building or portion thereof which is occupied or is intended to be occupied as a residence or sleeping place of one or more individuals, families or households.
ENFORCING OFFICER
A person or persons duly appointed by the Board of Health to enforce this chapter, including but not limited to the Health Officer, Sanitarian, Building Inspector, Housing Officer, police officers and fire inspectors.
FEED
To give, place, expose, deposit, distribute or scatter any edible material with the intention of feeding, attracting or enticing wildlife and/or bird feeding does not include baiting in the legal taking of fish, pest control and/or game.

FOGGING
Spraying in the form of a cloud for the control of insects within a prescribed area.
FOOD
Includes any article used for food or beverage for man or animal and every ingredient therein and all confectioneries, condiments and beverages and articles used for components of any such article.
FOOD-HANDLING ESTABLISHMENT
Includes any bakery, box-lunch establishment, cannery, catering establishment, confectionery, cheese factory, creamery, dairy, delicatessen, factory dining room or cafeteria, fish market, food-vending vehicle, grocery, hotel, luncheonette, meat market, packing house, restaurant, soda fountain or tavern or any place used in the production, preparation, transportation or handling of food intended for sale or distribution for consumption.
FREE-ROAMING CATS
Cats that roam outdoors and interact with feral cats and wildlife. Cats with specific owner, stray pets, or may have originated in one household and are fed or cared by other households in the neighborhood.

GARBAGE
The accumulation of animal or vegetable matter, or both, liquid or otherwise, that tends to decay.
HAZARDOUS OR TOXIC WASTE
Any solid waste or combination of solid waste, including toxic, corrosive, irritating, sensitizing, radioactive, biologically infectious, explosive or flammable solid waste, which poses a present or potential threat to human health, living organisms or the environment, or any waste designated as hazardous by the United States Environmental Protection Agency.
HOTEL or MOTEL
An establishment operated for profit, open to the traveling public for the keeping of guests. Food and beverages may or may not be part of the service.
KENNEL
Includes any building, yard enclosure, premises or lot of ground used as a commercial establishment for the keeping, raising, breeding or boarding of dogs and other animals.
LAUNDROMAT
An establishment where washing and/or drying of wearing apparel and other washable fabrics is done by the customer or an employee of the establishment.
LODGING HOUSE
A private dwelling where the owner, tenant or occupant is engaged in keeping two or more lodgers not related to him by blood or marriage, for a part of a day or longer period, under expressed contract or agreed rate of payment and where no food is served to such persons on the premises.
MEMBER or MEMBERS
That or those person or persons duly appointed by the Mayor and confirmed by the Council of the Borough to constitute the Board.
NUISANCE
Any condition which is dangerous to human life or health, or that which renders air, water, soil or any type of food hazardous or injurious to human life or health.

NURSE
A person licensed as such under the laws of the State of New Jersey.
NURSERY SCHOOL
A child-care center established for children of preschool age, usually for morning sessions only.
PERMIT or LICENSE
A duly authorized permit or license of the Board issued in accordance with this chapter or the regulations of the Board.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.

POULTRY
Includes chickens, ducks, geese, turkeys, guinea foul, pigeons, pheasants and all other fowl or winged animals kept, raised or sold.
PRESCHOOL CHILD
Any child between one year and five years of age.
PUBLIC PLACE
Includes any public place, as well as a restaurant, lunchroom, cabin, tavern, barroom, hotel and any and every establishment or place where food or beverage is sold or offered for sale to the public for consumption on the premises, and any camp, trailer, trailer camp, tourist home or public recreation place, or any other place of business where toilet facilities or water for drinking or culinary purposes is available for the use of the public.
REGULATIONS
Includes all regulations, whether general or special, which the Board may, from time to time, lawfully adopt and issue.
RUBBISH
Includes all coal or wood ashes, all loose material and dirt-like substances that tend to decay and all waste material, combustible and noncombustible, accumulated from buildings or from the cleaning of buildings.
SMALL ANIMALS
Includes rabbits, mink, guinea pigs, monkeys, chinchillas, hamsters, mice and rats, squirrels, raccoons and skunks and any other small animals or rodents kept or raised as pets or kept or raised for exhibition or other purposes or as a source of supply for laboratories.
SPRAYING
A mechanical application of insecticides to bushes, trees, plants or structures.
STRUCTURE
A combination of any materials, whether fixed or portable, forming a construction, including a building.
VICIOUS DOG
Any dog which has attacked or bitten any human being on three different occasions within a twelve-month period or which habitually attacks other dogs or animals.
WILDLIFE
All animals that are neither human nor domesticated.

The Board, as defined herein, shall be regulated and guided by the "Bylaws of the Board of Health of the Borough of Palisades Park," adopted on March 7, 1973, copies of which are kept on file in the offices of the Board of Health and Borough Clerk.
