A local law is hereby adopted authorizing the application of General
Municipal Law, Article 19-A, Business Improvement Districts, within the Town
of North Hempstead.
This local law shall take effect immediately upon filing with the Secretary
of State; provided, however, that such local law is subject to a permissive
referendum, and the Town Clerk shall forthwith proceed to notice such fact
and conduct such referendum if required by petition.

The Central Business Improvement District of Port Washington shall be
and hereby is established in the Town of North Hempstead, the Town Board having
found that the establishment of the district is in the public interest, that
all notice, mailing and hearing requirements have been complied with, that
all properties located within the district will benefit from its establishment
and that all property benefited is included in the boundaries of the district.
The boundaries of said district are contained in the district plan filed with
the Town Clerk on August 8, 1995, as set forth in Resolution 292-1995.
The improvements and provisions of services within the district shall
be pursuant to such district plan for the Central Business Improvement District
of Port Washington, hereinafter referred to as the "BID." All said services
shall be in addition to, and not a substitution for, required municipal services
provided by the Town of North Hempstead, the incorporated villages located
within the boundaries of the BID or Nassau County.
To the extent not otherwise explicitly provided herein, the provisions
set forth in Article 19-A of the General Municipal Law shall govern the operation
of the BID and the District Management Association in the town. If the provisions
of this local law are inconsistent with the provisions of any other local
law or act, the provisions of the local law shall be controlling.
Any amendments to the BID or the BID plan shall be made in accordance
with the provisions set forth in § 980-i of Article 19-A of the
General Municipal Law.
