No person shall cause a boat or vessel to become an abandoned vessel within the waterways of the Town.

No boat, vessel, barge or other normally waterborne structure shall be moved, kept, left, maintained, stored or repaired anywhere between the mean high-water mark and the nearest upland residential property, except in an established and regularly working commercial boatyard or commercial storage yard, without first obtaining the approval of the Town Board. Nothing contained in this section shall prohibit the owner of a craft which is propelled by wind power or manually and not by an engine, and which is 20 feet or less in length overall, from storing not more than two such craft upon the private property of such owner without first securing such permit as aforesaid. The Town Board may impose such conditions as it deems appropriate in granting its approval.

No boat, vessel, barge or other normally waterborne structure, of whatsoever size or description, shall be used for any commercial, residential, business or industrial purpose whatsoever within the jurisdiction of said Town or within 500 feet of said high-water mark unless written permission for such use shall first be granted by the Director of Harbor and Marine Enforcement upon approval by the Town Board.

Any vessel which becomes a hazard to navigation or sinks, becomes abandoned, grounds or is otherwise disabled may be removed by the Division of Harbor and Marine Enforcement, or agent thereof, or by the Marine Division of the Nassau County Police Department at the expense of the owner or the person in charge of such boat, and the Town or Nassau County shall not be responsible for any damage that may occur to such vessel in the course of removing same.
No person or persons, company, organization, etc., shall rent boats on a daily or hourly basis without keeping a register of persons renting same. The register must itemize the following: name, address, telephone number, time, destination and New York State registration number.

No person shall enter upon or engage in the business of selling, hawking, peddling or vending any property, article or product, goods or things from any boat or vessel on the waterways of the Town without having first complied with the provisions of Chapter 40 of the Town Code, Peddlers and Solicitors.
The Town will not be responsible for loss, damage or theft to boats and to their contents or to any other private property.
