There is hereby established in the Town of Webster a Department of Parks and Recreation.
It shall be the responsibility of such Department to plan, develop, manage and administer such parklands as are owned or may be hereafter acquired by the Town of Webster. It shall also be the responsibility of such Department to provide, conduct and supervise public playgrounds, playfields, indoor recreation centers and other recreation areas and facilities as may be owned, leased or made available to the town for recreation purposes by other governmental units or private property owners. It shall conduct such forms of recreation and cultural activities as it may deem appropriate and desirable and in the best interests of young and adult residents of the town.
There is hereby established the position of Director of Parks and Recreation, who shall be the administrative head of the Department of Parks and Recreation.
The Director of Parks and Recreation shall be appointed by the Town Board on the basis of his administrative ability, professional qualifications and experience in the development and operation of parks and recreation programs and facilities.
He shall serve at the pleasure of the Town Board and shall be in the unclassified service.
Powers and duties.
The Director of Parks and Recreation shall be responsible for planning, promoting, organizing and administering a comprehensive recreational and cultural program for residents of the Town of Webster of all ages.
The Director of Parks and Recreation shall be responsible for the development of a plan for the acquisition and development of existing and future parks, playgrounds, recreational areas and facilities and for supervising the development, operation and maintenance of such parks, playgrounds and recreational areas and facilities as may be now owned or hereafter acquired by the town.
The Director of Parks and Recreation shall advise the Town Supervisor and the Town Board with respect to matters within the jurisdiction of the Department as may be requested. The Director shall provide such cooperation and assistance to other departments of town government as may be requested and appropriate.
The Director shall prepare an annual budget for approval of the Town Board and shall authorize and approve all expenditures from funds appropriated for the Department. The Director may establish fees and charges for use of facilities and participation in activities under the supervision of the Department subject to the approval of the Town Board. All fees or charges collected by the Department shall be turned over to the Town Supervisor and become part of the general fund of the town.
There shall be within the Department of Parks and Recreation the following divisions: Parks and Recreation, together with such other and further divisions as any from time to time hereafter be deemed necessary and established by the Town Board. Each of said divisions shall be supervised by an administrative officer, who shall be a Superintendent of such division. Such Superintendent shall be appointed by the Director of Parks and Recreation with the consent of the Town Board and shall be in the exempt class of civil service.
The employees of the Town of Webster Recreation Commission shall be transferred to and continue as employees of the Department of Parks and Recreation with the same classification, pension and retirement rights and privileges as they had immediately prior to such transfer.
The Director of Parks and Recreation may from time to time employ such additional persons, including such special, technical or professional assistants, as may be within the budgetary allowance and appropriated for such persons as may be provided for by the annual town budget.
All employees of the Department of Parks and Recreation shall be under the general supervision and control of the Director of the Department of Parks and Recreation and may be removed by him for cause in accordance with applicable procedures and regulations of the Civil Service Commission.

There is hereby established a Parks, Recreation, Open Space and Athletic Review Board, which shall consist of 11 members appointed by the Town Board, of whom six members will be appointed for two years, and the remaining five members for three years. A two-year appointment is renewable no more than twice, a three-year term renewable only once, each such appointment for a maximum of six years.
The Parks, Recreation, Open Space and Athletic Review Board shall periodically meet with the Director of Parks and Recreation to advise and assist him in the preparation of plans and programs for carrying out the functions of the Department of Parks and Recreation. Such Board shall also review such plans and proposals for the acquisition and development of parks and recreation lands and facilities as may from time to time be referred to it by the Town Board or the Planning Board and make such recommendations to the Town Board and Planning Board in connection therewith as it deems appropriate.

The Parks and Recreation Advisory Board heretofore established by the Town Board in this chapter is hereby abolished, and all functions, duties, property and obligations of such Board are hereby transferred to and assumed by the Parks, Recreation, Open Space and Athletic Review Board.
